This new position for the spe counsel was necessary that they night attend the sessions of the KTand jury and participate with Gor don in the presentation of the Sin clair incident to the jirand jurors. Among the witnesses summoned tiiis morning was Ernest U. Hill, as sistant clerk of the committee on puh- Jtc lands. Mr. Hill was acting as clerk the questions were propounded to Mr. Sinclair, and has a record of the refusal of the oil man to reply. Kramer, Arthur McKean, Ralph E. Clepper, Elias H. Mortimer, Herman Oeltzeiler and Donald J. De- Uancey, who by reason of testifying before the grand jury, are not in dicted. Three Acts Specified. The indictment in which Mr. Lang ley is alone mentioned, sets out three alleged overt acts. The first chargf that on April 18. I*2l, he met EUaV H. Mortimer at the House Office build ing. Mortimer and Langley, May 7. 1921. conferred with Prohibition Com missioner John F. Kramer and caused the latter to write to Arthur McKean, prohibition director at Pittsburgh, authorizing the withdrawal of 4,000 cases of whisky from the Penwick Distilling Company at Cheswick. Pa. Mortimer went from Washington to Pittsburgh and May 26. 1921, Langley and Mortimer are said to have caused 4.000 cases of whisky to be trans ported from the distillery to the Union Drug Company in Pittsburgh. The indictment mentions Elias H. Mortimer, Herman J. Geltzeiler, Don i aid J. De Lancey and others were j engaged in procuring large quantl ) ties Os whisky for clients and Tom I Finn, Walter Carey and M. E. Huth , were desirous of selling whisky for i beverage purposes which was de posited in the Belle of Anderson Dis tillery, near Louisville, Ky„ which could not he withdrawn under the national prohibition act without spe cial permit. The alleged conspirators with those wishing to purchase the whisky agreed to pay to Elias H. Mortimer large sums of money, part of which, the amount not being stated, was paid over to Lang ley to induce Langley to use his influ ence with the prohibition officials and by promises of promotion to connive at md permit the withdrawal from the Louisville distillery to the store of the Union Drug Company in Pittsburgh. TWO INDICTED BEFORE. | By the Associated Press. PITTSBURGH. Pa.. March 28. ; Benjamin L. Moses and Harry Saltier, indicted by a federal grand jury’ yes terday at Washington with Repre sentative John W. Langley of Ken tucky and others upon charges of conspiracy to obtain the removal of 4.000 cases of whisky from tho Pen wick Distilling Company at Ches wick, this county, were indicted in the federal court here in 1920 charged with unlawful possession and transportation of whisky after a shipment had been seized by Depart ment of Justice agents. Moses and SatUer formerly con ducted the Union Drug Company' here, but that business was discon tinued. according to Saltier, who now conducts a stationery store, while Moses is employed in another drug store. Saltier declined comment when informed that an indictment had been returned against him at Washington. Arthur McKean of Beaver, named in the indictment, but not among those indicted, is a former state pro hibition director, and Ralph E. Clep per was chief clerk during his ad ministration. Russell M. WEST DENIES CHARGE. - Millard F. West, former United States deputy commissioner of inter- Inal revenue, who was indicted with Repre«ent*tlve Langley and lour I others on conspiracy charges, issued a statement today in which he de clared he was ■‘shocked" by the ac tion of the grand Jury. j Defending his connection with the application of the Union Drug Com pany for the withdrawal of liquor as "an open book,” Mr. West professed himself at a loss to understand why the Department of Justice recom mended such action “unless it was to shield a real criminal," by besmirch ing “the character of an innocent man.’* Continuing, Mr. West said: Ml»r*fW( station Is Charged* "The application of the Union Drug Company for such withdrawals was presented to me In May, 1921, while 1 was acting commissioner of In ternal revenue, by Mr. Mortimer, who represented himself as agent for the Union Drug Company. He had a letter of introduction, signed by Mr. Langley. He represented his client as being a large, reliable wholesale drug house, and I advised him that if the facts were as represented and the company’s application was sub stantially reduced, and if Mr. Kramer, the prohibition commissioner, approv ed the application for withdrawal, I saw no objection thereto. I advised Mr. Kramer of my attitude, and later was advised by Mr. Kramer that an authorisation had been made. Within a few days thereafter I was further advised by Mr. Kramer that an in vestigation disclosed the fact that the situation was not as represented by the applicant, and its agent. Mr. Mortimer, and that the authorization had been rescinded. • “I was amazed when advised sub."»e quently by Mr. Kramer that no basic permit on the Union Drug Company was on file, for no legal application for withdrawal could be approved unless a basic permit had been Issued. After the investigation by Mr. Kra mer I ordered that no basic permit should he issued to the Union Drug Company and Mr. Kramer was ad vised of this ruling Ho far as my acts are concerned, the situation was then a close hook and I never thereafter authorized the Issuance of a basic permit or directed the prohi- j bitton commissioner or any one to permit the Union Drug Company to withdraw any quantity of spirits. Any such withdrawal was made with out my knowledge and contrary to my orders as acting commissioner. "I had no conferences with any one with respect to this case except at the office of commissioner of internal revenue. Not an Improper word or suggestion was made in my presence at any of these conferences, and it was not until several weeks after I ceased to bo acting commissioner that I learned of ugly rumors and charges respecting the improper securing of a permit by said company from the prohibition commissioner for the withdrawal of said spirits, but my official acts were not involved in any such rumors, so far tus I knew. "The Department of Justice knows these facts, and the linking of my name with that of Mr. Mortimer in this transaction Is an act that I can not explain. I am staggered by it.
