4 DAUGHERTY SCORES: CUSTODY OF MEANS Attorney General DaugUerty yes terday struck back at the. Senate committee that is investigating his cilice through one of its star wit nesses. When Chairman Brookhart advised | the Department of Justice that Gas ton B. Means is to he held here under I lie committee's subpoena and cannot he brought to trial in Xetv York March 31, the Attorney General seiz ed the opportunity to make public the correspondence, with the following comment: ■ This is the price exacted by Means for his manufactured story that a •lap gave him SIOO,OOO to give to poor old Jess Smith." "The attorneys for the govern ment," Mr. Daugherty’s announce ment .said, “in the case against Gas ton B. ATeans, assigned for trial in New York on the 31st. have been ad vised by Senator Brookhart. chair man of the. committee, that the com mittee will hold Gaston Aleana in Washington under subpoena and pre vent Ins’ being tried in New York on the 31 si.” The correspondence given out hows that Hiram »’. Todd, special assistant attorney general at New A orb. wrote Senator Brookhart on March 17 informing him of the de lays in Aleans’ trial that have come about thus far. He inquired of the committee as to its convenience in releasing Means to appear, advising the committee chairman that the i rial date had been set for March 31 it Means’ suggestion. Senator Brookhart replied on March 31 to Air. Todd’s letter saying. “I s-e no possible way to finish with him (Means* in our committee before the 31st of Ailarch, and we will hold him under subpoena until we have finished." Air. Todd telegraphed Chairman Brookhart, March 2i>, as follows: Hits at Means. "Am I to understand from your letter to me of yesterday that not withstanding the contemptuous con duct of Gaston H. Means in delaying his trial, as explained in my letter tn you of March IT. you intend to hold him as a witness before your committee on Alareh 31 and thus ob struct the I'nited States dislriet eourt in proceeding with the trial of Means on that day. as heretofore ordered by said court, and as you were fully advised by my letter Os March 17? Please wire answer im-' mediately so I may present the mat ter to the court for appropriate ac t ion.” l,ate yesterday Chairman Brook hart informed Air. Air. j President, that your request for my j iestimation is also most untimely. It. j comes at a time when the truth is i vanishing falsehood from the public j mind, even though I have not as yet had an opportunity to place upon the witness stand before the Senate com mittee a single witness in my defense or in explanation or rebuttal of the whispered and gossipy charges against me. No better evidence of the failure to substantiate charges of wrongful ac tion on my part could be offered than the character of the proceedings by the Senate committee engaged in conduct ing the present inquiry. In such a tribunal, by such methods ajid out of th* mouths of such witnesses, an honest man could be convicted of any crime. Cite* Offers to Resign. 1 am aware. Mr. President, that the suggestion has been made to you that my retirement from the cabinet would serve the ends of party ex pediency. Had 1 believed this, I would have retired when this con tention was first raised. Twice since you became President, and when I could have dona so without criticism, I have offered to retire from your cabinet and you have in each in stance requested me to remain, be cause, as you were kind enough to say, of your entire satisfaction with the splendid accomplismments of the Department of Justice under my ad ministration. After this recent at tack, and while under fire, 1 stood my ground because I believe cow ardice and surrender of principle are never expedient and that every sacri fice of justice to clamor is followed by demands for still greater sacri fices. From the beginning this at tack upon me has. in fact, been an attack upon the administration and party, which my as sailants arc seeking to discredit for partisan purposes. Since the assault upon me began the purpose to attack , every administration official of prom inence, including the President him self. has been publcly revealed. Sees Grave trials. The American people confront a crisis in national affairs equal in gravity to any we have faced in all our history. Is this to remain a gov ernment of law and order, of consti tutional procedure, with its guaran tees of individual rights and its safe guards for equal justice to the high est and the humblest, or is it to be come a government by slander, by terrorism and by fear? In the battle .for my rights as an official and a citi zen the rights of every citizen of this republic are involved, for who of all our millions of people knows but that be may lie the next to be come the object of unjust accusation maintained by lawless inquisition.
