N.W, Phene National 6980. 45 INDICTMENTS VOTED AT MARION I Eight Deputy Sheriffs Are Charged With Murder in Textile Strike Disorder. By the Associated Press. MARION, N. C„ November 14—Re turning of 45 true bills by the McDowell County grand Jury yesterday over shadowed the limited progress made In the State’s effort to begin hearing evi dence in the case of Alfred Hoffman, organizer for the United Textile Work ers of America and four others on trial charged with insurrection and rebellion against the State. Yesterday afternoon the grand jury returned true bills against 37 strikers, charging them with rioting, resisting arrest and preventing workers from entering the plant of the Marlon Manufacturing Co. to work. Earlier in the day true bills were re turned against eight sheriff's deputies charged with murder in connection with a gun fight at the Marlon Manufactur ing Co. mill gates October 2, in which six men were fatally injured. The deputies named were B. L. Rob bins, W. A. Fender, Dave Jarrett. Jim Owens, Charles L. Tate, Taylor Green, William Twiggs and Robert Ward. All of these cases and the remainder of the 119 to be heard at this special term of Superior Court resulted from a series of disturbances growing out of [strikes at the Clinchfleld and Marion Manufacturing Co. plants during the past Summer. Conferences between attorneys and Judge O. Vernon Cowper of Kinston again occupied much of the proceed ings at the trial of Hoffman and the other four defendants. Fears that the special venire of 100 would be exhaust ed, without a Jury being obtained, caused the Judge to make arrangements to have another special venire called from Rutherford County, an adjoining county. Many of those called for duty dis qualified themselves by stating they thought the defendants guilty. Only one stated he thought the prosecution was at fault. Those on trial with Hoff man are J. Hugh Hall, Del Lewis, W. L. Hogan and Wes Fowler. All, with the exception of Hall, were strikers at - the mill. Will Russell, also Indicted and due to be tried with Hoffman and the others, failed to appear for trial and his bond of S2OO was forfeited. This is the second attempt to hold the trial, the first resulting in a mis trial when Hall escaped from Jail dur ing the trial. He was recaptured later. When court adjourned late yesterday all but 21 men of the special venire called from Rutherford County had been exhausted. Judge Cowper issued a call for a new venire of 75 called, the first 25 men of it to report this morning. Twelve men were seated in the jury box at conclusion of the day’s efforts, with 10 of them tentatively accepted by the defense and only two by prosecution counsel. DR. MASON TO HEAD ROCKEFELLER GROUP Br tbe Associated Press. NEW YORK, November 14.—The trustees of the Rockefeller Foundation yesterday elected Max Mason, former president of the University of Chicago, president of the foundation to succeed George E. Vincent, who has reached re tirement age nd will leave the presi dency January 1, 1930. Dr. Mason, who is 52 years old, is a widely known educator and has served as director of the Rockefeller Founda tion’s division of natural sciences since October 1, 1928. He was born In Madison, Wis., and was graduated from the University of Wisconsin, where he later was professor of mathematical physics. In 1903 he received the degree of Ph. D. from the University of Gottingen. Dr. Mason was president of the University of Chi c-30 from 1925 until 1928. President Vincent has been head of the Rockefeller Foundation since 1917. By the Associated Press. FLINT, Mich., November 14.—Legal steps to prosecute the group of junior executives of the Union Industrial Bank of Flint who are responsible for the gross shortage of $3,592,000 in that in stitution will be taken within 48 hours, it was announced yesterday by H. R. Wilkin, executive vice president. The net loss, now standing at $2,000,- 000, will be substantially reduced by in surance settlements and other recov eries, Wilkin said. C. S. Mott, vice president of the Gen eral Motors Corporation, who was chairman of the board of directors of the Union Industrial Bank, assumed the active presidency after the defal cation was discovered and turned over $3,592,000 of his personal funds to the bank to cover the shortage. The names of the bank executives in volved in the use of bank funds have not been announced. The shortage came to light after the recent crash in the stock market. FIRE HITS SEMINARY. THREE RIVERS, Quebec, November 14 (^p).—This city’s most destructive fire in 20 years yesterday destroyed the oldest wing of St. Joseph’s Seminary, causing damage estimated at $500,000. Valuable books and documents In the wing, which was erected in 1870, were lost In the fire. Strenuous efforts by firemen and volunteers saved the more modem parts of the seminary. Four priests, trapped In their rooms on the third floor, were rescued by means of long ladders. November 14.—Vice Presi dent George Wegener of the Aero-Arc tic Society, and other members of the society council last night said that It was out of the question for the Graf Zeppelin to fly to Seattle In the course of its Arctic flight next Spring. It was said in Madrid yesterday that the dirig ible would go to the American city on a flight from Spitsbergen.
