THURSDAY, SEPTEMBER It, 1930, INSURGENT MINERS LOSE ILLINOIS FIGHT Judge Upholds Lewis Injunc tion Against Using Union’s Name or Assets. By the Associated Press. JOLIET. 111.. September 11.—Mem bers of the insurgent faction of the Illinois Miners’ Union yesterday lost their fight to dissolve an injunction re straining them from using the name or assets of the United Mine Workers of America. The Injunction, obtained at Benton, 111., August 12, by supporters of John L. Lewis, international president of the original union, was upheld by County Judge Frederick A. Hill. In his ruling, Judge Hill said reor ganization of the United Mine Workers of America as effected at Springfield \99 years’ coffee leadership^ brings you Boscul Coffee Glorious flavor! March 15 bv the Insurgent group was made without authority, commenting that when the Springfield meeting was held the International Union still had its regularly elected officers. Judge Hill I “in my opinion, therefore, the hold ! mg of the Springfield convention did not operate as a reorganization of the United Mine Workers of America, did not create a new constitution for that bodv and did not Invest the members there elected as it* officers with any power as such." _ legality of the action of President Lewis in revoking the charter of the Illinois district was not of controlling importance in the matter before him. Judge Hill held. “The bill in this ease.” Judge Hill s decision said, “shows that the defend ants (the insurgent group) have re nounced all allegiance to the original international union of the United Mine Workers of America and by their con duct are usurping powers which they do 1 not possess and are interfering with the rights of complainants and others who still desire to adhere to and recog nize the lawful officers of that asso ciation.” , A Lewis revoked the Illinois charter and ousted its officers October 10. 1929. The insurgents obtained an injunction re straining Lewis from interfering with the Illinois district and Lewis failed in 1 an effort to dissolve that action.
