REGULATORY LAW MEETS COURT TEST Wisconsin Utilities Will Be Forced to Pay Cost of State Agency. BY GEORGE E. DOYING. For the first time since the advent of the modern Public Service Commission, a high court has passed upon the matter of compelling public utilities to pay ihe cost of their own regulation. The Su preme Court of Wisconsin has upheld a law to that effect enacted less than a year ago by the Legislature of that State. The law was attacked by the Wiscon sin Telephone Co., to which a bill had been rendered by the commission lor certain expenses in connection with a State-wide investigation of telephone rates being conducted by the commis sion In addition to a general challenge on the part of the telephone company to the power of the Legislature to im pose upon the public utilities of the State tlie cost of their regulation, the principal contention was that the Legis lature attempted to confer legislative power upon the commission when it was provided that the commission might ex empt any public utility from the pay ment of such costs if such action should be found to be in the public Interest. Exemption Section. The Supreme Court not only sus tained the constitutionality ot tile act in charging the investigation costs to the utilities under scrutiny, but, held that the Legislature had a right to authorize the commission to make exemptions when it found lii cumstances to justify such proceduie. The court stated that the exemption Fcction probably was not '‘hapnily framed" to express the evident legisla- , live intent, but that the Legislature j doubtless had in mind such investiga- . tions as might b-1 conducted for the in- j formation of the commission rather ( than for the direct regulation of a par ticular utility. . , .. . . . „ "It was not the legislative intent, paid the court, “to confer upon the Public Service Commission tbc arbitrary power which resides in the Legislature itself to determine what constitutes public interest. The Legislature pos sesses arbitrary power in suc.i matters and mav determine that to be in the public interest which the great majority of the people believe otherwise. While it may be that what constitutes the public interest is at times somewhat intangible in character, yet the Public Service Com mission mav pass reasonable judgment upon the facts and circumstances under | consideration and come to a reasonaole j conclusion as to what the public interest i requires under the circumstances, ana I Its conclusion is subject to judicia. review." Validity of Act. On the question of the general valid ity of the art, the court said In part: ••It is a well settled principle that the cost of regulating and supervising cer tain businesses may be itnoosea upon such businesses so long as the amount imposed does not exceed the reasonable cost of regulation and so far as tne power is not prostituted to the purpose of raising general revenue. Thu is the theory upon which a license .ee is ex acted of pawn brokers, pedolers and other businesses requiring police and other governmental supervision. It is the principle upon which insurance companies are required to nay the cost of investigation made by the insurance department, and upon which banks are made to bear at least p portion of the expense incident to their examinations by the Banking Department.” (Copyright, 1932.) Special Dispatch to The Star. NEW YORK. January 22 —Curtail ment of productive activity in New England during November was less than during the previous month, ac cording to the current Issue of New England Business, published by the National Shawmut Bank of Boston. This was the result of improvement in su.h industries as metal, lumber, pa per and rubber, which partially offset the sharp reductions in the textile, leather and related industries. As would be expected in view of pro ductive activity, employment and av erage weekly earnings in Massachu setts manufacturing establishments de clined less in November than in Oc tober. Average weekly earnings per employe was about 10 per cent below a year ago. or approximately the same as the decline in the Massachusetts cost of living index. Although the decline of this index has been omy one-half the decline in wholesale commodity prices, component parts of the cost of living ind-’x, such as retail food and clothing prices, have declined tnree-quarters as much as wholesale prices. BALTIMORE, January 22 —A new transmission }ine uniting two units of the National Electric Power Co. system has been completed. The new line, ap- j proximately 14 miles in length, forms a connecting link between the Eastern Shore Public Service Co. operating unit in the National system, and the territory of the Maryland Light <fc Pow er Co.'acquired by the Eastern Shore companv during the last year. Built for 11.(foo volts, the line extends be tween Queen Anr.es and Queestown in Maryland. Last vear Eastern Shore acquired the j Mar' land Light &, Pow er Co. and por- j tions of the East Coast Utilities Co., j rounding out the company's holdings 1 on the Eastern Shore section of Mary land, Delewaro ar.d Virginia. Since j then transmission lines have been steadily extended to unite the new ter ritory with the main transmission sys tem of the company, which has a steam generating station at Vienna. I NEW YORK. January 22 (A5).—Yes terday’s transactions in gold resulted j in an increase of $1,169,000 in the i country's monetary stock, according to j the New York Federal Reserve Bank statement. Mortiz von Lyncker, Who Quarreled Violently With Ad- I miral von Tirpitz, Succumbs. By the Associated Press. POTSDAM, Germany, January 22.— Gen. Baron Mortiz von Lyncker, once chief of former Kaiser Wilhelm s mili tary cabinet, died yesterday at the age of 78. In 1927 he quarreled violently with the late Admiral Alfred von Tirpitz, who, in his memoirs, accused Gen. von Lyncker of having influenced the Kaiser banefully during the World War Gen. von Lyncker was appointed chief of the imperial German military cabinet in 1908 and occupied that im portant post through the war days until July 30, 1918, when he retired because of ill health. *-• INTEREST RATES. NEW YORK, January 22 (A>).—The Gulf, Mobile & Northern Railroad has posted a notice of a 20 per cent reduc tion in the pay of its organized employes who were not affected by the wage cut of last July, it was reported in railroad circles here today. The July reduction was said to have been taken voluntarily by a consider able number of the road's workers In order to help it meet interest charges. NEW YORK, January 22.—Bonds were firm again today, with railroad descriptions inclined to resume a brisk advance. Trading was fairly active. The market opened with a steady tone and readily absorbed an over night accumulation of profit-taking sales in the speculative types. The in stant success of the New York City $100,000,000 6 per cent loan proved a bullish influence in all parts of the investment market. Bonds of the three and four year maturities were quoted at a slight premium in counter trading, while the five-year bends, which seemed to b° much in favor, were quoted at 10034 to 101 It was an interesting sidelight on the present bond market that New York City bonds, usually the most conserva tive of securities, were the medium for heavy speculative buying. Many bought the bonds today on the theory that in a revival of the money market New York's corporate stock might very well advance to a 4 per cent yield basis, which would yield purchasers of the 6’s at par a profit of 9 points. The entire municipal list strength ened Bonds of other cities, such as Philadelphia, Pittsburgh, San Francisco and many county issues, which have recently been quoted around a 5.60 to 6.20 per cent basis, were today in demand around 5.50. The railroad list reflected a strong market for railroad stocks, based on optimistic reports coming from the Chicago wage conference. Nickel Plate 6’s, due this year, were more than 5 points higher at one time and more than 40 points above their December low Gains of a point or more occurred in Nickel Plate 4>2's, Mobile & Ohio 4'2s, Missouri-Pacific general 4s and Erie 5’s. ,, . There were small declines in a lew issues that have recently had wide gains such as Alleghany 5 s. Southern Pacific 4'2's. Southern Railway 4's and Rock Island 4'2's, but these were exceptions. , ... Some industrials were fractionally lower on profit-taking, but most of them were unchanged to a shade higher Dodge Bros. 6s, Goodyear 5s, National Dairy Products 5 Us and many others were firm. United States Government issues were again heavy. The Treasury 4'4s were most active and dropped about one-half point. The Treasury 3s were off nearly a point. Liberties eased. This followed a firmer demand for money, with the time money rates showing a slight ad vance over Thursday's levels. There was also some switching from Treas uries into the New York City loan. Foreign bonds were irregular. Ger man government issues, after opening about 2 points lower, recovered only partially, and other Germans sagged London and Paris markets were both dull pending definite decision as to whether the Lausanne Conference has been abandoned or only postponed. Bonds were steady at the opening. The prices of most domestic railroad bonds .opened off a shade under a mod erate volume of overnight selling or ders, but these declines were quickly made up in early trading and most speculative issues of the type of Erie 5s. Missouri-Pacific 5s Nickel Plate 4'2s, Frisco 4'2s and Chicago & North western 434s were little changed. In dustrials were firm. Dodge Brothers 6s gained fractionally. Utilities, like American Telephone 5s, Consolidated Gas 5'2s and New York Telephone 4'2s were fractionally better. United States Government issues were narrowly lower. In the foreign department, German government issues dropped nearly 2 points and German municipals and bank bonds also went lower. Canadian government issues were higher with Canadian exchange. S. Growers. Bv the Associated Press MANCHESTER, January 22—A bit ter battle is being fought out behind the scenes here between international interests connected with the marketing cf raw cotton. It is a commercial war in which the moves are hidden, due to the entire lack of official current statistics since last October 3. when the Liverpool Cotton Association ceased publishing its official daily figures concerning cotton import ed and estimated spot sales by descrip tion. together with prices paid. Within the last few weeks whole ship loads of Russian cotton, containing ap proximately 0,500 bales of each ship ment, have again appeared at Man j Chester and Liverpool. Russian Shipments. Before the American slump in 1929 Russian cotton was almost unheard of in England, and what small quantity reached British spinners was locally considered to be of very low quality. Then, in 1930. came the time for the Russians, under their five-year plan, to start paying their long-dated bills of exchange against machinery and plants purchased three years ago in England. To obtain sterling currency cotton was shipped to England from Russia on consignment and sold for the best price it could realize for cash. I The Lancashire Cotton Corporation experimented with the first shipment. It was found that the cotton had been carefully selected in even-running lots of a bright-colored strict-middling grade, and was capable of competing with good-quality American and low quality Upper Egyptian. After the first few shipments had been disposed of satisfactorily, forward contracts w-ere placed and a considera ble business negotiated with important British spinners, which increased the im ports of Russian cotton into England to approximately 175.000 bales for the year ended July 31. 1931. Well informed quarters of the British cotton industry teiieve that Russia will not be able much longer to restrict her own imports of raw cotton as she has done since the economic crisis began in 1929. End to Menace Seen. To enable Russia to export cotton the cotton-spinning industry inside Russia | has been severely penalized. At present the price asked for Russian cotton is I from 55 to 75 points above competitive American cottons. This latter factor I alone, providing credit facilities to ob tain American dollars are readily avail able to the British importer, will see the end of the Russian cotton menace to American growers.
