RAIL PENSION ACT HELD EXPERIMENT Executives’ Counsel Ex plains Law to Trans portation Club. # R V. Fletcher, general counsel of the Association of Railway Executives, told the Washington Transportation * Club at a luncheon meeting yesterday St the Raleigh Hotel that the railroad retirement act is “a great" social ex periment that may be worth its cost. Carefully avoiding for ethical rea sons all political and legal questions involved in enforcement of the act due to the recent attack on its constitu tionality by 137 of the Nation's rail roads, Fletcher devoted his discussion chiefly to the history of the legislation and the complex problems confronting the Railroad Retirement Board in in terpreting the law. Fletcher said the act. representing the first intrusion of this sort of a governmental force into the transpor tation field, had attracted considerable attention because it had been regarded In some quarters as an entering wedge Into all forms of industry. He declared It also had raised the question whether a tax should be imposed on industry -lor retirement of its employes. Voluntary Agreement. Nearly all the railroads of the coun try. Fletcher explained, now have a voluntary retirement arrangement whereby employes are pensioned at the age of 70 with an annuity based on the length of service. In not a single instance, he said, was the pay ment of the pensions suspended during the period of the depression, although In some cases reductions had been made in the rate of the annuity. The future of this voluntary retire ment system, as well as the cost of compulsory plan under the retirement •ct, Fletcher said, are two of the ques tions that cannot be answered at the present time. Estimates of cost, he eaid, have varied markedly as well as the estimates of the number of rail road employes who will be retired Within the next two years. $120 Is Maximum. Fletcher also pointed out that $120 » month is the maximum amount of a pension under the retirement act, and that annuities now paid by some of the railroads under their own voluntary retirement system are in excess of that amount. Fletcher traced the history of the Voluntary railroad pension system back to 1884 when it was first introduced by the Baltimore & Ohio Railroad. Bince that time, he said, the railroads have paid out a total of $341,000,000 In annuities from their own earnings. A number of prominent Government as well as transportation officials at tended the luncheon as guests of the club. These included John L. Rogers of the office of the Federal Co-ordi nator of Transportation; Col. Alfred P. Thom, sr„ associate counsel of the Association of Railway Executives; Dr. Julius H Parmelle, director of the Bureau of Railway Economics of the American Railway Association, and F.! W.
