aide mmm State’s Case Termed Weak and Silly in Criticism of Militia Guard. By the Associated Press. FLEMINGTON, N. J.. November 10.—The inclusion of State troopers In the Hunterdon County jail guard of Bruno Richard Hauptmann, Lind bergh kidnap-slaying suspect, was again criticized by the defense today and as vigorously defended by the prosecution. "At a legal conference of the prose cution recently four State police offi cials attended," Lloyd Fisher, associ ate defense counsel, said today, "thus proving our contention that the State police are attempting to build up a case to convict this man right or wrong and close the books. "That is why there should be no State police guards in Hauptmann's cell. If they are prosecutors In this case, they'ought to get out of the jail and leave the guarding to neutral persons. They are using Hauptmann to clear their skirts of an Inefficient handling of the case. I “We do not object to a guard of a deputy sheriff, but the presence of the State police Is contrary to all precedent.” Calls It Everybody’s Case. To this Prosecutor Anthony M. Hauck, Jr., of Hunterdon County, re plied as follows: “The defense contention that this is a State police case is ridiculous. This is the Nation's case, the State's case, the people's case, Hunterdon County’s case. This is one of the most gruesome crimes in the Nation's criminal history. ‘‘We deny that the State police are the prosecutors. The State police are present because they had charge of the Investigation under the direc tion of Col. H. Norman Schwarzkopf by specific designation of Gov. Harry A. Moore. “When the crime was committed. a question of jurisdiction was raised and the State police were summoned rather than county authorities. The State police have had the co-opera tion of the police departments of the United States Government and New York City. "Practically every criminal case in rural counties such as Hunterdon necessitates the help of the State police in Investigation and apprehen sion of criminals. We are not defend ing the State police in this case be cause they need no defense.” Says Charges "Weak and Silly.” Fisher, commenting on the state ment of Attorney General David T. Wllentz that the prosecution will not reveal what further evidence it gathers in its case before the start of the trial, January 3, said "the State is not giving out any more informs tlon because what has been given out Is so weak and so silly that the public reaction has been adverse to their case.” “I cite,” Fisher said, “the example of Miller Whited, whose story of see ing Hauptmann near the Lindbergh estate was discredited. The State's case Is so flimsy and weak that they don’t dare risk any more statements." In reply to a question as to his opinion of the value of Dr. John F. Condon, ransom intermediary, to the prosecution, Fisher said: “Jafsie has no weight In the case and he’s as useless to the prosecution as Whited.” Through Fisher, Hauptmann today appealed to the public to withhold judgment on him and not be “misled by ballyhoo put out by the prosecu tion.” Fisher said Hauptmann now Is reading newspapers (with all refer ences to the Lindbergh case deleted) and finds they relieve him of much of the strain of Imprisonment. HOPKINS WILL SPEAK Harry L. Hopkins, Federal emer gency relief administrator, will dis cuss relief from the national view point at the United States Conference of Mayors in Chicago November 22-24. Another speaker from Washington will be Assistant Attorney General Joseph B. Mrs. Rushmore Patter son, chairman of the Administration Committee, will present a charter to the Arlington County Post in a cere mony during the conference.
