By the Associated Press. NEW YORK, February 5.—A long standing tradition is at stake in the decision of officials of the Stock Ex change to continue trading at the time of announcement of the Supreme Court's ruling in the gold-clause cases Maintenance of a "free and open market’’ at all times in which sellers can find a buyer and bidders receive an offering has been a prime principle of the Nation’s leading security mar ket for so long that Wall Street mem ory runneth not to the contrary. In three decades the rule has been ig nored only twice because of national or world crises. | The first of these occasions was at the outbreak of the World War in 1914, when dealings were suspended for a period of six weeks. The sec ond extended from March 4 to 14, 1923. inclusive, and covered the period of the bank holiday in the United States Even the latter suspension, it was said in exchange quarters, was due rather to the lack of banking | facilities which made money settle I ments impossible, than to inability to i bring buyers and sellers together in an oroerly market. T* 4. 1»J i. «n...i.l —4 - *u tt, I VUiVU Ui A A A A AA ilW iUl that a sharp division of opinion ex isted in brokerage, exchange, and securities commission circles iegard ing the advisibility ol maintaining an open market when the court renders in judgment, expected sometime in the next week or two. It is noted that a new factor now figures in the situa tion, since the Securities <$c Exchange Commission has the power to close markets under its control, “in the pub lic interest.” Conferences are known to have been held between exchange officials and members of the Government regula tory body, and it is assumed that the former were able to give assurance that satisfactory measures would be adopted for the limiting of price swings to reasonsble proportions, and that closing would not be necessary. Chicago Closing Due. CHICAGO. February 5 (/P>.—Execu tives of the leading Chicago securities and commodity exchanges yesterday were empowered to suspend business on the exchanges temporarily in the event the Supreme Court announces its gold clause decision during trad ing hours. The action, taken by directors of the Board of Trade and the Mercantile Exchange and by the governors of the Chicago Stock Exchange, was consid ered a move to give the executives of these exchanges authority to stop trading at their own discretion. Suspensions Not Planned. WINNIPEG, February 5 (JP).—'The council of the Winnipeg Grain Ex change is not considering suspending trading when the United States Su preme Court issues its decision on the gold clause” litigation. -• - ASSOCIATED OUTPUT RISES. NEW YORK. February 5 (Special). —For the week ended January 26, As sociated Gas & Electric System re ports net electric output of 56.161.557 i units (kilowatt hours>, an increase of 17.2 per cent over the same week a year ago. This is the largest per cent increase over a comparable period re ported since May 12. 1934. Net out i put for the four weeks to date showed an Increase of 5.1 per cent. TAXES ARE CITED AS MARKET FACTOR Doubt of Industry’s Ability to Carry Huge Load Be comes Influence. BY GEORGE T. HUGHES. Special Dispatch to The Star. NEW YORK. February 8.—There are plenty of other deterrent* to in vestment commitments in s^euritie* aside from the uncertainty with re gard to the impending decision in the gold clause cases Among these, and perhaps most fundamental of all. is the doubt about the ability of industry to carry the tax burden incident to the Govern I ment's huge expenditures for relief and for social security and at the same time have anything left over in the way of profits. Earning statements already reveal a decreasing percentage of net to gross, which is suggestive to say the least, and as the administration's plans de velop the nrospective charge on busi ness becomes steadily larger. For a long time stock prices were \ supported oy expectation of currency inflation. There are still those who look for such inflation, but their num ber is not as large as it was and in any event, there is less faith in the protection provided by ownership of an equity :n any manufacturing or distributive business Only the excep i tional enterprise could survive infla tion anyway—the best situated being, of course, the original producers of durable commodities As a market factor, taxation now looms larger than inflation, including with taxation higher labor costs. Take, for instance, the plan of Senator ; Wheeler to tax corporation assets with the intent to “eliminate monopolies and holding companies." The chances I are that this particular scheme will | never get anywhere, but its advocacy j Is not calculated to encourage invest ment in stocks of the largest corpora tions to which the average Investor always gives the preference in times of depression. I cwvjva me Lciumuy lxxul xzuni new on legitimate and absolutely necessary taxation must absorb a larger and larger proportion of earnings and the reluctance to invest new money be comes understandable.
