IN KIDNAP Cl [ Forthwith Subpoena Issued at Request of Mrs. Rob inson’s Counsel. By the Associated Press. LOUISVILLE, Ky., October 9.—A forthwith subpoena for Melvin H. Pur vis, former Department of Justice agent, to appear as a witness at the Stoll kidnaping trial here of Thomas H Robinson, sr., and his daughter-in law, Mrs. Prances A. Robinson, w’as Issued by Federal Judge Elwood Hamil ton today at the request of defense Counsel. Jack Norman, counsel for Mrs. Rob inson. abruptly terminated his cross examination of H. H. Reinecke, De partment of Justice agent, to ask the court for the forthwith subpoena. Purvis' name was among the list of witnesses •originally subpoenaed for the trial. Norman told the court he could supply Purvis' present address. Stopping of Auto. Defense counsel indicated it wanted to examine Purvis as to what hap pened when and after Federal agents stopped the automobile in Southern Indiana bringing Mrs. Alice Speed Stoll to Louisville after she had been ransomed for $50,000. M. C. Fslkner. agent at Chicago last year, testified that the elder Robinson had told him he received a telephone call from Robinson. Jr., the night of October 8, 1934, which he prevloualy denied, and that he found a plat or diagram of the Indianapolis apart ment where Mrs. Stoll was held prisoner, in Robinson, sr.’s, own hand, in his room. Entering the third day of the trial, the Government continued to trace the trip of the $50,000 ransom from Louisville through Nashville, Tenn.. Guthrie, Ky„ and Terre Haute to Indianapolis where it vanished. Robinson Guilt Now Denied. Neither the defendants nor any one Use has denied that the actual kid naping was carried out by Thomas H. Robinson, jr„ considered by the De partment of Justice as the Nation’s No. 1 fugitive kidnaper. The question 6f the guilt or innocence of his wife and father turns upon their motlvea in co-operation with the Stoll family In payment of the ransom. Against Robinson, sr„ the Govern ment has presented testimony to •how: That he possessed a plat or diagram of the Indianapolis apartment where Mrs. Stoll was held prisoner for six days, that he was aware his son was the kidnaper, that he suggested his son’s wife act as ageril in delivering the $50,000 ransom, that he was in touch with his son by telephone and these communications were available to the Department of Justice by means of wire tapping. Wife'* Alleged Part. Against Mrs. Robinson, Govern ment witnesses have testified: That she was a willing messengef In delivering the ransom. That she and her husband rented the apartment-prison under asaumed names. t That she urged her husband to make his getaway quickly with the ransom monef"after she delivered it. T>at she took $500 of the ransom moriey, later giving it up to Federal •gents. Mrs. Robinson's counsel won from Mrs. Stoll an admission that she was •’grateful" for the now accused wom an’s part in effecting her release, per haps savirg her life, and Robinson’s lawyers drew from C. C. Stoll an as sertion that he urged Robinson to act as agent for the Stoll family and "of fered to put It in writing." PROCESSING TAX FOUGHT 6PRINGFIELD. Ill. October 9 UP). —A suit to prevent the Government from collecting processing taxes was filed in Federal Court here yesterday bv Hiram Walker & Sons, Inc., large Peoria, 111., distillery. * The bill of complaint said that since May, 1934, the firm had processed 2 909,595 bushels of corn, on which the processing tax will total $153,430, Including interest.
