BOY 10 KILLED FATHERON ML Declares He Shot Parent Because of Cruelties to Family. By the Associated Press. READING, Pa., March 10.—The State began laying before a jury of six men and six women today its case against Louis Toontas, the 14-year-old boy accused of shooting his father to death “because he was a mean man.” Because of the tousle-haired boy’s age. the State seeks only a conviction, and will not ask the death penalty. George Toontas, 15, a brother of the defendant, testified that “a figure that came out of the darkened parlor” of their home shot his father the night of February 15. George said he accompanied his father on an auto repair Job that night, rhey returned about midnight. The father alighted first and was about to bang up his hat in the vestibule, when i burst of rifle fire hit him. The father staggered from the house, rhen the "figure” rushed from the larkened parlor from which the shot :ame. Twice more the rifle flashed tnd the father crumpled to the street. Louis, captured over the mountains n Schuylkill County the day after a rifle bullet killed his 45-year-old father, James, outside the Toontas lome here the night of February 15, seemed hardly to realize the serious ness of the occasion as he was brought into court for the opening of the ;rial yesterday. He winked at "the kids” in the court gallery as District Attorney John A. Rieser demanded his conviction. Dur ing the selection of a Jury and two alternates, he was more interested in bis boy friends who managed to slip ay the guards and into the court room. Whether his counsel, former Judge John B. Stevens and Harry Lee, would place him on the stand to tell his story, when the time came, remained s secret. Jail officials and investigators say the youth told them of beatings he and others in the family suffered at the hands of the father, and that he has declared, "I’d do it again,” in re lating brutalities he claims led to the slaying. District Attorney Rieser, outlining the State’s case, pictured the boy as laying in wait for his father. As the elder Toontas left his automobile, out side the home, the boy blazed away from a window of the house. Then he got into the car and drove off. Hours later, a boy was seen loitering about a gasoline station near Pottsville. Truck drivers fed him pieces of their sandwiches and pies. An attendant’s suspicion was aroused and he notified authorities, who took the boy into custody and brought him back. DIES AT RESIDENCE Mrs. Emma H. Fishburn Was Long Active at Mount Pleasant Church. Mrs. Emma H. Fishburn, widow of Rev. Dr. M. Ross Fishburn, former pastor of Mount Pleasant Congrega tional Church, died yesterday at her home. 3109 Mount Pleasant street, after a long illness. She would have been 71 on March 19. Long active in church work, Mrs. Fishburn last year completed 25 years of service as parish visitor of the Mount Pleasant Church. Her hus band was pastor there from 1893 un til his death in 1909. Surviving Mrs. Fishburn ate a son, Prof. Hummel Fishburn of the Penn sylvania State College, and a daugh ter, Mrs. Cortland Manifold, Chevy Chase, Md. Funeral services will be held at 11 a.m. tomorrow in the Mount Pleasant Church. Rev. Dr. Russell j. Clinchy, pastor, will officiate. Burial will be private. Members of the family have re quested those who would give flow ers to refrain from doing so and in stead contribute to a memorial to Mrs. riMiuuia to ue given to tnc cuuicxi. Francis Riggs, chief of the Puerto Rican con stabulary, who was assassinated at his post on February 23, will be held at 11 a m. March 23 In the National Shrine of the Immaculate Conception at Catholic University. The mass will be celebrated by the Rev. T. Lawrason Riggs, Catholic chaplain at Yale University. Arrange ments for the service are under the direction of the Rev. Maurice S. Sheehy. assistant to the ractor at the university. Col. Riggs, a graduate of Yale, was a graduate student at Catholic Uni versity. working in the department of Oriental languages. RITES FOR COL SHUNK Retired Army Officer Will Be Buried Thursday in Arlington. Funeral services for Col. William A. Shunk. U. S. A., retired, will be held at 2 p.m. Thursday at Gawler's chapel, 1756 Pennsylvania avenue. Interment, with full military honors, will be in Arlington National Cemetery. Col. Shunk died suddenly yesterday while sitting in the lobby of the Cairo Hotel, where he made his home. He was 88 and a native of Westville, Ohio. He is survived only by his brother Andrew of Westville. Lodges Seek Charters. Charters have been asked by 25 lodges forming in Florida, according to an announcement from the Amer ican Federation of Government Em ployes. STEIN WILL BE IN ARKANSAS Wife of Naval Academy Instruc , tor Was Victim of Auto Accident. By the Associated Press. ANNAPOLIS, May 10.—The body of Mrs. Mary P. Stein, 43, wife of Lieut. Comdr. Maurice H. Stein, U. S. N., who died yesterday from injuries received in an automobile accident, will be sent to Hot Springs, Ark., for burial. Comdr. and Mrs. Stein were injured Sunday night when their automobile left the Weems Creek road, struck a pole and rolled down an embankment. Mrs. Stein died of a fractured skull. Comdr. Stein, who was not seriously hurt, is a member of the faculty ot the Naval Academy on duty in the de partment of mathematics. MRS. LUCY E. MORGAN EXPIRES AT AGE OF 81 Lifelong Resident of Capital Will Be Buried in Rock Creek Cemetery Tomorrow. Mrs. Lucy Ellen Morgan, 81, widow of John W. Morgan and a lifelong resident of this city, died yesterday at her home, 2926 Newark street. She had been ill six months. Mrs. Morgan was the daughter of the late Mr. and Mrs. Joseph Davis. Her husband for a number of years was proprietor of the Morgan Steam Laundry and later was employed m the Post Office Department. He died in 1930. Interment Lincoln Memorial Cemetery. in POLICEMAN BURNED IN RESCUE BETTER Adams Saved Infant Nephew When Gasoline Explosion Threatened Home. Policeman James Walter Adams, 29, who braved death to rescue his infant nephew front a blazing house, was re ported recovering in Sibley Hospital today from severe burns about the arms, face, head and body. A gasoline explosion made an in ferno of the kitchen of the two-story Adams home at 116 U street northeast yesterday, trapping the baby and his mother, Mrs. Mary Moore. Adams’ sister-in-law, on the second floor. She leaped to safety, breaking her leg in the fall. As she landed in the back yard she called to Adams that the infant Robert was upstairs. The officer ran through the burning kitchen, up the stairs and brought Robert to safety. The child, un harmed, was taken to Sibley, along with his mother. Adams, who directs traffic at Four teenth and F streets, explained through blistered lips the accident which caused $500 damage: “I was using gasoline to clean the stove. It was one of those stoves that has a pilot light. You don’t need a match to light it. I thought I had turned out the pilot light, but evidently there was still a flicker of flame. ‘‘It caught my gasoline-soaked rag and jumped to a pan of gasoline. I tried to stamp out the fire, but pretty soon the whole floor was flaming.” CHARLES L. EBAUGH DIES IN TAMPA, FLA. Former Capital Resident Was Once Employed in Depart ment of Justice. Charles L. Ebaugh, formerly of this city, and active in church work here for many years, died last Thursday in Tampa, Fla., after a short illness, it was learned here today. Mr. Ebaugh left Washington sev eral years ago to live in Florida. For many years he was employed as a copyist In the accounts division, De partment of Justice, until retirement in 1927. Prior to leaving here Mr. Ebaugh was long a member of the board of Mount Vernon Place M. E. Church south, ana taught a Sunday school class there which bore his name. He is survived by his wife, a son, Charles J. Ebaugh, Philadelphia; a daughter, Mrs. W. W. Haines, Olney, Md., and four grandchildren. Burial was to be in Tampa. MRS. WILLIAMSON DEAD Mrs. Samuel Beverly Williamson, for 28 years a resident of this city and active in social circles, died Sunday at a Memphis, Tenn., sanitarium after a long illness. Mrs. Williamson was taken last week from her residence, at the Stoncleigh Court Apartments, to the sanitarium for treatment. She came here from Tennessee. She leaves a sister, Mrs. L. H.
