J., February 25.— State Senator William H. Smathers, a “holdout" from the United States Senate, because the Democratic party found it expedient to keep him here, is ready to surrender his $500 State legislative post for the $10,000 Job in Washington. He said today he would close ‘in about a week” his desk in the State House, where he has been besieged by lobbyists tor State and national causes. “I'm going to be in Washington when the fight starts on the Supreme Court,” the former Southerner drawled. Smathers, a Democrat who defeated Warren Barbour, Republican, last No vember. called President Roosevelt’s plan to reorganize the Federal Judiciary “a step in the Interest of progress.” “It s a fine thing,” the Atlantic City attorney said, "to bring younger men in to absorb the experience of the older ones and at the same time have the older judges absorb a youthful outlook from new blood.” Smathers, 45, a former county judge, planned to stay in the Legisla ture until he had a chance to vote for a measure to permit pari-mutuel horse race betting. His own resolu tion, however, was committed to a committee referred to as “the morgue” and a similar resolution adopted by the assembly last night went to the same Senate committee. Smathers remained in the State Senate because his presence gave the Democrats 10 votes in the 21-member Senate. A court battle is being fought over the controUing Republican vote. POWER CONCERN AND 16 INDICTED IN DETROIT By the Associated Press. DETROIT, February 25 —A Federal grand jury yesterday Indicted the Consumers Power Co. of Jackson, Mich., two of its officials and 14 other persons on charges of conspiracy to violate the internal revenue laws. The Government contends the com pany devised a plan to supply gas at commercial rates to still operators. In four counts, the indictment alleges the company has supplied gas for illicit stills since 1934, with knowl edge of its illicit use, and that it has installed commercial meters for use in private dwellings where stills were i operated.
