SKIN-STIMULATING VITAMIN 0 GUARANTY TRUST INJUNCTION DENIED Bank Is Permitted to Vote Controlling Stock in Chesapeake Corp. By the Associated 1 ress. ‘ NEW YORK, April 7— Federal Judge Albert C. Coxe today denied the petition of Robert R. Young for an injunction restraining Guaranty Trust Co., third largest bank in the United States, from voting controlling stock in Chesapeake Corp., which it holds as trustee, at a special stock holders’ meeting in Baltimore to morrow. The decision was a setback in Mr. Young’s fight with powerful Wall Street banking interests for control of the Chesapeake & Ohio Railway, most profitable remnant of the former $2,000,000,000 Van Swreringen rail empire. Middle Holding Company. Chesapeake Corp. was the middle holding company of the Van Sweiin gen corporate set-up and controls the railroad. Nominal control of Chesa peake Corp. rests with Alleghany Corp., top holding company of which Mr. Young purchased control with a small rash outlay last spring. The controlling Chesapeake stock, how ever, is pledged as collateral in Guar anty’s hands for Alleghany bonds. Young charged last week in a Fed eral court equity action that Guaranty for improper reasons connected with its financial relations with J. P. Morgan & Co., General Motors Corp., and Morgan, Stanley & Co., had vio lated its trusteeship and was trying to get control of the C. & O. manage ment. At that time Judge Coxe issued a temporary restraining order, and a special meeting at Baltimore called for Monday over Mr. Young’s protest was postponed until tomorrow. order Is Rescinded. Today the judge rescinded that order. He also declined to remove Guaranty as trustee and declined to issue an order directing Guaranty to give Mr. Young, as chairman of Alleghany Corp., proxies for a bloc of 780.100 of the 1,278,000 shares of Chesapeake stork which the bank holds as trustee. All these remedies refused by the judge were asked by Mr. Young. The net effect of the decision will be to enable Guaranty tomorrow to cast its controlling vote for three new Chesapeake Corp. directors of its own selection. These would have a balance of power on the board, now split in a tie, and would be able to change the management of the C. & O. at the railroad's annual meeting April 19. ENVOY TO SPEAK Cuban Ambassador Will Go to Miami to Address League. Bt the Associated Press. Cuban Ambassador Pedro Martinez Fraga will leave for Miami Friday to speak before the Pan-American League at a ceremony Saturday in observance of Pan-American Day. Martinez Fraga planned to meet his two nieces, the Misses Ana Maria and Esther Carabia y Martinez, who will return with him to Washington, leav ing Miami Sunday. He will leave here Tuesday for New York to address both the Pan-American Society and Co lumbia University students. TRANSFER BILL PASSED Senate Backs Coast Guards' Shift to Naval Reserve.. B> the Associated Press. The Senate passed yesterday a bill to permit transfer of enlisted men in the Coast Guard to the Naval Re serve after 20 years or more of service. The bill provides men so transferred shall be retired by the Coast Guard after completion of 30 years of service. Glenn Carow, 22-year-old Washing ton pianist, whose talent has won wide recognition, obtained a license yester day to marry Miss Ruth Wynne Fulton. 21, of 3539 Edmunds street N.W., a music pupil of Mr. Carow's. For the past year, the two have been playing Sunday night concert pro grams over a local radio station. They will be married late this month by the Rev. Charles T. Warner, rector of St. Alban's. LONDON. April 7.—A labor party victory in West Fulham constituency, London, strengthened today the left wing campaign to force Prime Min ister Chamberlain into a more liberal treatment of the Spanish government. Dr. Edith Summerskill's election yes terday over the Conservative, C. J. Busby, by a majority of 1,421 in a campaign fought on foreign policy issues, was the eighth victory for a Labor candidate for Parliament in 45 local contests since 1935. The district went Conservative in 1935, Sir Cyril Cobb, now dead, win ning by a 3,483 majority. People's Ultimatum Seen. The first by-election since Anthony Ellen resigned as foreign minister, it was immediately interpreted by Dr. Summerskill as a peoples’ ultimatum to Mr. Chamberlain to go "back to the League or get out.” "Chamberlain’s child-like faith in the dictators is not shared by the people of the country,” she said. "They remember with alarm that at the very moment the national government was asking the nation to have trust in their negotiations with Mussolini he was boasting about his troops invading Spain.” Labor has not lost a seat in a local election In more than two years and party leaders saw a trend which they j declared was an indication British sentiment was against Mr. Chamber lain's program.
