Ex-Marine Executed By Firing Squad lor Murder of Detective Utah Killer Pronounced Dead 2 Minutes After 5 Riflemen Shoot By the Associated Press. SALT LAKE CITY, Feb 5.—Five Volunteer riflemen, paid $25 each. shot to death Walter Robert Avery, killer of a policeman, in the Utah Prison yard today. The shots were fired at 8:23 a m. and two minutes later Dr. Rich Johnson pronounced Avery dead. All persons condemned to death : in Utah must choose between the firing squad and the hangman—and Avery, 34-vear-old former marine, picked the riflemen. Although five rifles rattled at Sheriff. John R. Watson's' signal, only four spat death-dealing slugs. One of the .30-caliber weapons loaded secretly bv the sheriff con tained a blank cartridge, but none of the executioners knew which drew this weapon. The riflemen stood in a cellblock adjoining the yard with a canvas 1 hung over the door, their guns thrust through eight-inch slits. From a range of 22 feet they fired bullets into a target pinned over the heart of the condemned slayer who as a marine had exchanged shots with Nicaraguan revolutionaries without getting a scratch and also had come unscathed through later brushes with the law. The death sentence was imposed on Avery for the slaying of De tective Hoyt L. Gates in a gun bat tle during a chain store grocery holdup at Ogden February 11, 1941. Servicemen, War Workers To Visit Lincoln Museum Continuing its “Washington Wel comes You” series, the defense com mission of the Federation of Churches will hold an informal cul tural session for servicemen and war workers Sunday at 4 p.m. in the Lincoln Museum. 511 Tenth street N.W.. the site of the old Ford's Theater. The former meet ing will relate to the days when the Octagon House served as a pro visional capital and Dolly Madison stayed there, and the latter dis cussion will be on art in China.
