Bldg. 15th at N. Y. Ave. V ' y / / / X. . ' \ | Civil Courts May Get Dog Ownership Case I Ownership of Sporty, a little black mongrel dog, was still unsettled after Municipal Court Judge Ar mond W. Scott yesterday dismissed charges of larceny of the dog against Mrs. Eines Byrd, colored, of l the 900 block of M street N.W. Mrs. Louise Bennett, colored, of the 1100 block of Tenth street N.W., told John Lane, assistant United States attorney, she intended to take the matter to the courts, even though offers of other pets have been flowing in from sympathetic dog lovers. Mrs. Bennett’s son. Miller, 11, tes tified at a trial last March 22 that Mrs. Byrd tool: the dog away from him in November as he led Sporty on a leash at Ninth and M streets N.W. He said the dog had been his since he was six weeks old, nearly a year. Mrs. Byrd declared Sporty is the dog which was given to her in 1943 and disappeared in November, 1944. Municipal Court Judge Thomas D. Quinn at that time declared a mistrial when a material defense witness, alleged to have given the dog to Mrs. Byrd, failed to appear in court. The case yesterday was dismissed at the request of Mr. Lane who said the evidence in the first trial showed Mrs. Byrd claimed the dog as hers in good faith and this was sufficient to defeat a charge of larceny. Mrs.' Bennett still has recourse in the civil courts, he said.
