Deputy FTC Issues Rules To Protect Buyers of Artificial Limbs To protest physically handicapped persons from "misrepresentation and deception” in buying artificial limbs and kindred devices, the Federal Trade Commission today issued trade practice rules to govern the entire artificial limb industry. Spokesmen for the FTC and for the Justice Department said the new rules to bring the artificial limb in dustry under the scope of the Fed eral Trade Commission Act was partly the result of an indictment last November charging 45 corpora tions and 34 individuals with violat ing the Sherman antitrust law. The indictments grew out of Gov ernment accusations of a conspiracy to fix high, unreasonable and non competitive prices for the sale of artificial limbs to amputees through out the United States. At the Jus tice Department, it was sftid trial of the indicted corporations and in dividuals was still scheduled to begin April 29. Curbs Testimonials. The new trade practice rules not only prohibit “combination or co ercion” in restraint of trade and to suppress competition with regard to prices but lay down a regulatory framework which would draw tight restrictions on “deceptive testi monials or depictions,” “deceptive demonstrations,” and “fictitious” prices. The FTC pointed out there are about 600.000 users of artificial limbs and devices in the country, including 16,000 veterans of World War II. “Rehabilitation of persons who have undergone amputations,” the FTC continued, "with resulting restoration to a self-supporting and normal safety of industry’s pros thetic devices and upon their proper fit, alignment, and appearance when put to actual use.” Confers With Industry. The FTC said that it had first considered such rules at the sug gestion of the House Labor Sub committee on aid to physically handicapped. In co-operation with industry members, it continued, a general trade practice conference was held at Chicago, after which the rules were drafted. A public hearing was held February 15. Among rules laid down was one which declared the FTC “disap proves” the practice of undertak ing to supply amputees by mail order specifications, declaring It be lieves ‘'that satisfactory and proper fit cannot be attained except by personal fitting.” The indictments of last Novem ber declared the annual sales vol ume of artificial limbs in the United States aggregates $10,000,000.
