U.s. Weighs Dismissal
Plea in Suit to Void
Cotton Margin Boost

■ Government attorneys said today
they probably would move for dis
missal of a suit filed yesterday in
Federal District Court here to void
recent Government regulations in
ci easing margin requirements for
cotton futures trading to approxi
mately $50 a bale.
The suit, filed by eight cotton
planters and two cotton exchange
members, was directed against Eco
nomic Stabilizer Chester Bowles.

and Secretary of Agriculture An
derson.
Jtichard H. Field, chief counsel for
OPA and Henry M. Hart, Jr., chief
council for the Office of Economic
Stabilization, expressed the opinion
the Federal District Court does not
have jurisdiction in such a case.
They said the suit properly should
have been filed with the Emergency j
Court of Appeals, a special court
set up under the Price Control Act
exclusively to hear complaints
against OPA regulations.
Plaintiffs in Sui'.
The palintiffs in the suit include:
J. E. McDonald. Texas State com
missioner of agriculture; J. A.
Cooper of West Memphis. Ark.: B.
F. Harbert of Robinsonville. Miss.;
Sidney Levingston of Ruleville,
Miss.; B. E. McDearman of Cleve
land. Miss.; A. E. McDonald of
Waxachie, Tex.; C. W. Parnell of
Dallas, Tex.: W. B. Yancey, Mari
anna, Ark , all cotton planters, and
H. M. Dunscomb of Memphis, mem
ber of the New Orleans Cotton Ex
change. and Edward J. Wade of New
York City, member of the New York
Cotton Exchange.
Secretary Anderson on April 3
signed an order setting the mini
mum initial margin requirements at
$10 a bale, effective April 9, and
providing for increased margin ac
cording to the selling price of the
futures contract, if cotton advances
in price.
The plaintiffs assert all cotton ex
changes have increased their margin
requirements in conformity with the
order and they are now up to about
$50 a bale.

The suit alleges the planters can
not, "without prohibitive cost," sell
cotton on the exchanges as a hedge
against loss while their cotton Is
growing.
It also asserts Mr. Wade and Mr
Dunscomb are unable, except at a
heavy loss, to sell cotton for futures
delivery to protect themselves.
It charges that Mr. Bowles did
not have authority to require Sec
retary Anderson to issue his order
of April 3 and specifically requests
an order be entered restraining the
Federal officials from attempting to
enforce the order, and entrance of
a declaratory judgment declaring
the April 3 order void.
When informed of the filing of
the suit, Mr. Bowles said that he
had no comment.
Stratford-on-Avon Marks
Shakespeare's Birthday

STRATFORD-ON-AVON. Eng
land, April 23. — Thousands of
Britons, free from the shadows of
war, walked through the luxuriant
greens and gardens of this War
wickshire town on the banks of the
Avon today on the 382d anniversary
of the birth of William Shakespeare.
"Cymbeline,” starring Valerie Tay
lor of the London stage, will be
presented in the memorial theater;
overlooking the Avon as a feature
of the birthday celebration.
Stratford clergy and other dig
nitaries will participate in cere
monies at various Shakespeare
shrines. Tire local museum and
churchyard will be open to the
throngs.
NBC in New York quoted the
Moscow' radio last night as saying
the entire Russian nation would
commemorate Shakespeare’s birth
day today with extensive cere- j
monies ranging from performances i
of his plays in the 27 languages *of
the Socialistic republics to a con
ference of Russian Shakespearian
scholars in Moscow'.
Army Names Feringa
Civil Works Director
Col. Peter A. Feringa has been
named director of civil works.
Office of the Chief of Engineers
War Department. Lt. Gen. Raymond
A Wheeler, Chief of Engineers, to
day announced.
The colonel succeeds Col. James
H. Stratton, who has been assigned
to duty with the Governor of the;
Panama Canal one. In his new |
post, Col. Feringa, who is a gradu
ate of Lehigh University, will have,
direct charge of the Army Engineers’!
program of rivers and harbors and
flood control improvements.
Col. Wayne S. Moore, who served
in the Pacific theater, succeeds
Col. Feringa as resident member
of the Board of Engineers for Riv
ers and Harbors. i

Chairman Thomas announced he
intended a move to send the admin

J But Senator Bridges, Republican,
of New Hampshire, speaking for a
j minority group, demanded additional
I time for hearings on his substitute
plan to retain the present War and
Navy Departments, create a new Air
Forces Department, and attain unity
through a Council of Common
Defense.

’’It only invites delay and in
action,” Senator Hill said. "It is
form with no substance and would
promote further diversion and
separation."
Senator Austin, Republican, of
Vermont, who with Senators Hill
and Thomas helped draft the single
department plan, said there was
no need for additional committee
delay. «
Senators Hill and Thomas as
serted that every possible plan, in
cluding all details of Senator
Bridges’ substitute, were examined
carefully both at public hearings
and the lengthy drafting sessions
that produced the unification bill.
Johnson Ready to Vote.
Senator Johnson, Democrat, of
Colorado said he was ready to
vote now.
"I'm for unification first," he told
a reported. "I’m for the Bridges
bill as second choice. If we can’t
get a single department then I’m
against subordination of air power
to the present old departments.”
Senator Wilson, Republican, of
Iowa had still a different view.
"I’m opposed to any action at this
time.” he said.
