Man Held in Slaying Of Soft Drink Official Waives Jury Trial By th« Associated Press FREDERICKSBURG, Va„ Sept. 10.—William Francis Harvey, 23 year-old ex-serviceman, has waived jury trial and may throw himself on the mercy of the court when his trial on a charge of murder in the highway slaying of a Leesburg Coca Cola plant executive comes up to morrow in Spotsylvania County Cir cuit Court. Harvey, who. police say, admitted in a signed statement that he killed O. J. Beckerman. 50, after the soft drink man. on his way home from a meeting in Richmond, had given him a ride, is now in the Fredericks burg Jail. Defense Attorney Francis B. Gouldman, appointed by Judge Leon M. Bazile to defend the veteran, said Harvey had waived trial by jury. Spotsylvania Commonwealth's At torney T. Stokeley Coleman refused to say whether he will seek a death sentence in the case. Harvey, whose home is In Syra cuse, N. Y., has made no request for bond since his capture in Phila delphia June 18. During his time in jail here he has been the official ward of City Sergt. L. E. Chittum. who, as a State police sergeant, is credited with uncovering one of the principal clues which led to the ar rest—the serial number of Becker man's watch which was found in a Philadelphia pawn shop. The arrest of Harvey ended a search of nearly three months after the body of Mr. Beckerman—stabbed twice and robbed of $70 and a gold pocket watch—was found in Spotsyl vania woodland by some children. Mr. Beckerman's automobile, also stolen, was not found until a short time before Harvey’s arrest. Harvey told officers he accidentally stabbed Beckerman. who had given him a ride, when he fell forward while showing the older man a souvenir war knife, and that he then became excited and plunged the knife into Mr. Beckerman's body again. Builder* t 'Toby' Returns Home; Father to Prosecute Maid 'to the Limit' By Aisoctotod Preii KANSAS CITY. Sept. 10.—Friend ly 3-year-old Madeline (Toby* Tobias is home today, extremely tired and covered with Insect bites but otherwise none the worse for her exciting experience with a hitch hiking maid, who disappeared with her five days ago. A rousing welcome awaited curlv halred, brown-eyed Toby on her ar rival here last night In a chartered plane with her parents, Mr. and Mrs Philip Tobias, to whom she had been returned earlier in the day at Terre Haute. Ind., where police found her in a humble home awaiting adop tion. The maid. Mildred Louise Everett. 22, was held by the FBI at Terre Haute. She was picked up there soon after Madeline was found. A kidnaping charge here awaits the former inmate of the Ohio Girls’ Industrial School, who told Terre Haute police she loved the little girl and wanted her for her own. Will Prosecute “to Limit." Toby’s father, an overseas veteran and now a salesman for a small loan company, said he would prosecute "to the limit” the maid, who dis appeared with the Tobias' only child three days after he had picked her up on a street as a hitch-hiker and hired her as a housekeeper because his wife was ill. Toby was too tired to take in much of the party at her modest home, celebrating her return. Her mother bathed her and treated her numerous chigger and mosquito bites before putting her to bed. A few minutes later Toby was asleep. Her 24-year-old mother said she had been too tired to say her usual prayers. Offered for Adoption. Toby's recovery came on a tip to Terre Haute police from a foundry worker. Omer Kunkhouser, who said the hitch-hiking maid had agreed to turn the child over to him and his wife for adoption. He recog nized the child as the missing Toby through a newspaper picture. Robert Vance, chief of detectives at Terre Haute, pieced together this story: The maid hitchhiked with the child to Terre Haute, arriving there Friday with 15 cents. They went to the Goodwill Industries where the maid obtained employment as I a housekeeper in the home of Ben ; Bailey, father of seven children whose mother left home several 1 weeks ago. Funkhouser. visiting his mother next door to the Bailey home, saw Toby and when he admired her the maid, posing as her mother, offered her for adoption.
