G. Farbenindustrie patents in pending litigation, they will be “uti lized to encourage free competition in the fields to which they relate.” David L. Bazelon, assistant At torney General in charge of alien property, made the comment in con nection with a ruling by the United States Circuit Court of Appeals in New York last week covering division of property in this country once owned by »ermany’s Farbenindus trie. The property was seized by the Government during the war and some of it now is claimed by Stan dard Oil Co. of New Jersey. The Circuiit Court, in a modifica tion of a district court decree at Boston, ruled the Government was entitled to certain patents covering production of synthetic rubber, soap, tuluol, asphalt paving and hydro gen, and that other patents relating to the processing of oil and gasoline should go to Standard. Stock in leresis in companies affiliated with Standard were divided similarly. The Justice Department said the case required a review of “dealings between Standard Oil of New Jersey and I. G. Farbenindustrie over a period from 1926 to our entry into World War II,” which the Govern ment contended included “sham transactions” relating to Farbenin dustrie assets in the United States. The division of seized assets fixed by the Circuit Court is subject to ap peal to the Supreme Court by either the Government or Standard Oil within 90 days.
