District 1411 'Test of Government's Milk Price Case Due In Court Monday The Government’s anti-trust case against seven Washington area dairies, the Maryland and Virginia Milk. Producers’ Association and its general manager, Bruce B. Derrick, will get its big test in District Court Monday. Justice Richmond B. Keech, who late yesterday denied motions for separate trials by the Alexandria and Harvey dairies and a change of venue for the Alexandria dairy, will hear final arguments Monday on these points: 1. Validity of the indictment, which is contested by Mr. Derrick and the Wakefield dairy in connec tion with the filing of motions to dismiss the charges against them. Dairy Asks Postponement. 2. A plea for a month’s postpone ment of trial, originally set for May, which has been requested by Chest nut Parms-Chevy Chase .dairy. It is believed that granting of this re quest would force the court to delay trial until the fall term. 3. Bills of particulars filed by all defendants except Richfield Dairy. The granting by the court of either motion to dismiss would have the effect of throwing the case out of court, and a Justice Department official said that, if this were to happen, the Government probably would appeal directly to the Su preme Court. Proceedings yesterday were marked by an assertion of Robert H. Winn, special assistant to the Attorney General, that all except Mr. Derrick, the producer co-operative' and Chestnut Farms Dairy “are in the category of reluctant conspirators.’’ While Mr. Winn did not elaborate LUMBER N. Mr. Winn's comment was made in connection with arguments of At torney William J. Blum, Jr., for Alexandria Dairy, and Attorney Ralph W. Mr. Blum contended press reports and editorials in Washington papers and advertise ments by the Embassy Dairy, which was not among those indicted, had prejudiced the public, and that, therefore, his client could not receive a fair trial here. Yesterday’s session disclosed for the first time that Mr. Derrick had retained William E. Leahy and William J. Hughes, jr„ as attorneys. Elwood H. Seal continues as coun sel for the producer group. Mr. Leahy, in his dismissal mo tion, argued that Federal statutes, including the Agricultural Adjust ment Act, immunize agricultural co-operatives from prosecution un der anti-trust laws.
