Directed Acquittals Denied 5 Defendants In Hod Carrier Case Justice Alexander Holtzoff in Dis trict Court today denied defense motions for judgments of acquittal for five men on trial for conspiracy to embezzle funds of Washington area locals of the International Hod Carriers’ Union (AFL). The Jurist held that the Govern ment evidence showed a single con spiracy and not a number of con spiracies. as the defense contended. The Government claims $100,000 of union funds were siphoned off for the benefit of the conspirators through the illegal agreement. The missing defendant, Larry Kelly, formed the conspiracy and was its hub, Justice Holtzoff said, atlhough it had many spokes. The object, he declared, was to embezzle funds of the labor unions, the ma jority of the money going to Kelly himself. The jurist concluded there Is sufficient evidence produced by the Government to be passed on by the jury. rniycr* nir * icbchkw. After the jurist refused to free the defendants, Defense Counsel Charles E. Ford and Austin F. Canfield sub mitted a number of prayers—pro posed instructions to the jury on the law—to be passed on by Justice Holtzoff. Only three of the defendants took the witness stand yesterday before the defense closed its case. Justice Holtzoff declined to ad mit evidence purporting to estab lish the death of Kelly. The Gov ernment concedes only that Kelly is now “unavailable” and has obtained a separate trial for him. Mr. Canfield told the press after court that he is prepared to show Kelly died at the age of 52 on June 23, J944, at Lae, New Guinea. The lawyer said Kelly had served aboard the merchant vessel Clarence Dar row and died of heart failure. Profit Charges Withdrawn. Leo Rover, special assistant to the Attorney General, told the jury the Government was withdrawing charges of a secret profit made by the defendants George Morgan, Joseph Speed and Kelly in pur chasing the property at 523 New Jersey avenue N.W. He said the de fense within the past few days sub mitted to him bills for repairs on this property, showing they paid for them out of their own pockets. Although the three men took title to the property, it later was sold to .he union. Mr. Ford put on the witness stand Ray England, conciliator for the union. Mr. England showed the defendant Isaac Weiner, Leonard town (Md.) business man, deeded property to Local 832 in Southern Maryland, as well as the union office building near Cedar Point, Md., and •xtended the lease on two barracks for four months for a nominal sum.
