Secretary of the Army Royall held up the death sentence—which he said involved 17 men—late yes terday after the Supreme Court had refused by a 4-to-4 vote to consider a release petition for the condemned men and others convicted in the same case. Mr. Royall said Gen. Lucius D. Clay, American commander in Ger many, will investigate ‘‘serious al legations" made in the petitions. The appeal charged the United States with using “sham” courts, threats and third-degree methods to force confessions from the Germans, ft was filed with the Supreme Court by Willis M. Everett, jr., of Atlanta, who as an Army officer defended the Germans at their trial in Dachau, Germany. Mr. Everett’s habeas corpus peti tion listed only 12 men sentenced to pe executed day after tomorrow out pf 74 convicted of taking part in the Malmedy affair. Secretary Royall mentioned 17 condemned men and a total of 72. There was no imme diate explanation of the difference in the figures. The Supreme Court after its special session issued a brief an nouncement stating that the petition was denied. The announcement said shat Chief Justice Vinson and Jus tices Reed, Frankfurter and Burton felt that the Supreme Court had no authority to consider the appeal, rhe announcement added that Jus tices Black, Douglas. Murphy and Rutledge favored hearing the ap peal immediately. Those under death sentence were listed in the Supreme Court petition as Valentin Bersin, Friedel Bode, Kurt Briesemeister, Friedrich Christ, Josef Diefenthal, Ernest Gold schmidt, Hubert Huber, Paul Her man Ochmann, Joachim Peiper, Deorg Preuss, Erich Rumpf and Paul Zwigart. Wife Finds Tree Surgeon Fatally Shot in Bedroom Gerald E. Harris, 31, of 4308 Rus sell road, Kaywood Gardens, Mount Rainier, died last night in Prince Georges General Hospital from a gunshot wound in the head. Mr. Harris, a tree surgeon, was found in the bedroom of his apart ment about 6 p.m. by his wife. A 22-caliber rifle was nearby, police said. According to police, Mr. Harris had oeen drinking before he came home ind his wife told him she was going Dut while he “slept it off.” He is said to have replied “I’m going to sleep it off. all right—for good.” Two hours later Mrs. Harris re sumed to the apartment with their 3-month-old child and discovered tier husband. Police said he had seen despondent over financial af fairs. Dr. James I. Boyd, Prince Georges County coroner, said he would issue a certificate today.
