Murray Suspension of
Officers as Illegal

HARRISBURG, Pa., May 27.—
Counsel for suspended union officials
have told the State Supreme Court
that President Philip Murray of the
CIO-United Steelworkers ‘‘by-passed
all provisions cf the Ccn-titution

officers of the union's new Kensing

clared yesterday that the union’s
constitution requires that officers be
given “a fair trial" before they can
be suspended.

erty to W. D. Gravatt, Murray-ap
pointed administrator of the local.:
Opposing Mr. Smith's contention.
James Gregg, counsel for Mr. Mur
ray and Mr. Gravatt, told the court
> the CIO president acted on the re
quest of the 7,500 members Of the j
local who work for the Aluminum1
Co. of America.
Mr. Gregg added that the mem
bership voted at a meeting to ask
Mr. Murray to appoint a three-man
commission to investigate the af
fairs of the union.
Action la Outlined.
This commission, Mr. Gregg said,
found the local president, Frank
Hill, and the other 10 officers guilty
of "grave irregularities.” He em
phasized that the officers were not
suspended until they were given an!
opportunity to appear before the
union's Executive Board which he
said they failed to do.
Mr. Smith said immediately, how
ever. that the Executive Board’s
action in upholding the commis
sion’s finding “was just a rubber
stamp approval.”
Mr. Murray, he said, did not call
a meeting of the board but merely
polled its members by telegram and
received SO sustaining answers.

Owens Gains Slightly
The condition of Representative
Owens, Republican, of Illinois, con
tinues to be "very serious," but a
"very slight improvement" was noted
early today, Bethesda Naval Hos
pital officials reported. The legis
lator has been at the hospital since
Sunday, when he was stricken with
a heart attack.
