The ruling was issued yesterday | bv Judges Charles W. Woodward and Stedman Prescott. It denied county objections to a suit chal lenging the constitutionality of a 1945 State law which authorized the commissioner to require licenses for ! operation of taxicabs. The suit was brought against the commissioners and Albert E. Con Petition Asks Prompt Trial In Keleher Divorce Case Attorney James J. Laughlin yes . terdav afternoon filed papers in the United States Court of Appeals, seeking a prompt trial or the di vorce suit brought by his client. Mrs. Anna T. Keleher, against John B. Keleher, whom she has described as a gambler. Justice F. Dickinson Letts of Dis trict Court on Wednesday, denied Mrs. Keleher temporary mainte nance, pending trial of the divorce action. She lives at 2737 Devon shire place NW. Justice Letts held that she had "amply provided” for her own main tenance "in taking from safe de posit boxes a considerable sum of money" belonging to Mr. Keleher. Mr. Laughlin yesterday filed a paper asking the Court of Appeals permission to file a petition in the appellate court for a writ of pro hibition and other relief.” It also asks the appellate court to curtail the longer summer vaca , tibns of District Court justices to 26 davs and to declare an emer gency in order to dispose of a back log of District Court cases. In the alternative, the petition he seeks to file, asks that a justice of the Court of Appeals be designated to hear the Keleher divorce case. Mr. Laughlin previously had complained of the long vacations. raris, county public utility agent, by attorneys James H. Pugh. James R. Mi.ler and Lee Miller. They repre sent Robert H. Swisher, owner of the Piney Branch Cab Co. Mr. Miller said that as a result of the ruling, he would advise Mr. Swisher not *to comply with the or dinance. About 200 cab drivers in the county are affected. Court attaches said that unless the defendants file an answer, the court may issue an injunction pro hibiting them from enforcing the ordinance. In thier decision, the jurists said: the Motor Vehicles Act prohibits any j county or municipality from enact-; ing locaP legislation setting up li censing requirements for motor ve-; hides. They said the law' authorizing the commissioners to adopt the taxi cab ordinance did not amend the, State-wide Motor Vehicles Act to permit such action.
