Named in the six-count indict ment was Robert Edgar Him maugh, 43, of St. Rose, La., a former engineer of the Federal Barge Lines. Each count charged a false statement regarding Communist Party membership or Communist activity. Three of the statements were made before a Loyalty Board and three in letters to Commerce Department officials. United States District Attorpey iJ. Skelly Wright said Himmaugh was discharged "as a direct result” iof the loyalty hearing last fall. More Indictments Indicated. A hint that more indictments of this type might be forthcoming was given by James E. Palmer, ; jr.. of Washington, special as sistant to the Attorney General, who aided the grand jury investi gation. In a formal statement an nouncing the indictment Mr. jPalmer said: i The present case Deing tne nrst case of prosecution for falsehoods at a loyalty hearing itself, it | should be a stern reminder to ! all who appear before loyalty boards to tell the truth or face \ the consequences. "Whenever and wherever any other such cases arise the De partment of Justice intends to prosecute them.’' Himmaugh surrendered to the United States marshal about two hours after the indictment was returned. Apparently agitated, he told re porters: “I have nothing to say. I don't know what it's all about.” Mr. Palmer and Mr. Weight joined in the announcement of the indictment, which was re turned before Federal Judge Herbert W. Christenberry. Five-year Term Possible. The specific charge was making a false or fraudulent statement within the jurisdiction of a Gov ernment department. Conviction carries maximum penalty of five years and $5,000 fine. Honesty By the Associated Press The Nation’s top tax collector told Senators yesterday that he has to rely on the people’s honesty and arithmetic 95 per cent of the time. He doesn’t think it works very well. “One’s imagination is staggered,” said Revenue Commissioner George J. Schoeneman, at the thought of how much more rev enue might be collected if all in come tax returns were checked. He went before a Senate appro priations subcommittee to ask that the Revenue Bureau be al lowed 5,543 more- employes than the House provided in a Treasury Post Office money bill for the year starting July 1. Mr. Schoeneman said the bureau is so short-handed that only one out of four of the individual short form income tax returns can even be checked for correct additions and subtraction. In the 1948 fiscal year, Mr. Schoeneman said, the bureau re ceived 88,465,725 tax' returns. Less than 3,000,000 were audited, he said, and 79,736,205 were simply accepted as filed. Gen. de Gaulle Asks Clemency for Petain By th» Associated Press PARIS, Mar. 30.—Gen. Charles de Gaulle yesterday asked clem ency for a wartime opponent, Marshal Philippe Petain. Marshal Petain, 92, whose Vichy regime condemned Gen. De Gaulle to death in absentia for leading the Free French, is serving a life sentence on the lie d’Yeu off the southwestern coast of France. Gen. De Gaulle told a news con-1 ference he was surprised no one had asked him about Marshal Petain. It was Gen De Gaulle, as head of the provisional French gov ernment after the war, who com muted Marshal Petain's death sentence to life imprisonment for treason. t Doctors recently reported that Marshal Petain is “showing a gradual weakening due to old age.” At that time government sources said it had been decided to ease the conditions of his im prisonment. The aged ex-marshal is no longer required to make his own bed and clean his cell. Bishop of Lourdes Tells Truman of Peace Crusade By th« Associated Press The Right Rev. Pierre Theas, Bishop of Lourdes and Tarbes, told President Truman yesterday about his crusade of prayers for peace and the gratitude of Prance for American aid.
