Hiss Cites Threats To Jurors in Asking Change of Venue By th* Associated Pr«s NEW YORK, Oct. 5.—Affidavits by two jurors about threatening letters and telephone calls since they voted to acquit Alger Hiss have been filed in support of his plea to have his second perjury trial shifted out of New York. Counsel for Mr. Hiss, former State Department official, filed a motion late yesterday asking that the trial be held in the Federal Court at Rutland, Vt. Btvafell* 1*7* against the defendant that he cannot obtain a fair and impartial trial in that district.” Extensive and sometimes unfair publicity given the first trial was claimed as cause of the prejudice. Argument Set Monday. The defense move, opposed by Government counsel, will be ar gued in court next Monday, the date set for the start of the trial. Mr. Hiss is accused of denying falsely before a Federal grand jury that he provided Government secrets for transmission to pre war Soviet spies. The first trial ended July 8 with a hung jury—eight for conviction and four for acquittal. The two jurors who said they were threatened are Mrs. Louise A. Torian of Manhattan and Louis Hill of the Bronx. Mrs. Torian said that two days after the trial ended she received a postcard addressing her as “Comrade” and saying: “and you wonder why decent men and women can’t get into this country. Drop dead or go over with your ‘(Jommie’ friends.” she said she later received several similar post cards. Tells of Prowler. McLean, said in the petition papers that, "The hubbub in the metropolitan press about this case has not by any means disappeared since the trial.” The defense papers said pub licity here before, during and after the trial has been of “such unprecedented volume and in some respects of such extraordi nary virulence” that it would be impossible to get a "fair and im partial” second trial before an unprejudiced jury. The defense said that in Ver mont—Mr. Hiss’ favorite vacation spot—there has been less copious and less prejudicial publicity, and no great public sentiment for or against Mr. Hiss or the prosecu tion. Hanes Named to G. 0. P. Finance Committee Post < John W. Hanes, former Under secretary of the Treasury, has been appointed vice chairman of the Republican National Finance Committee, it was announced to day. Announcement was made by Guy George Gabrielson, chairman of the Republican National Com mittee, and Sinclair Weeks, chair man of the finance committee. Mr. Haines, who also is a for mer Securities and Exchange Commissioner, lives at- Millbrook, N. Y. _ Streetcar Operator Cleared in Traffic Death A coroner’s jury yesterday ex onerated Michael C. Embrey, Jr., 24, streetcar operator, in the traf fic death of Francis E. Proctor, 73, colored, of 3 New York avenue N.W. The jury ruled the death an accident. - Mr. Proctor was fatally injured September 27, when he was struck by a streetcar operated by Mr. Embrey at Pennsylvania avenue and Jackson place N.W. He died the following day in Freedmen’s Hospital. Food Chain Association Opens Convention Oct. 12 The National Association of Food Chains will hold its 16th annual convention here beginning next Wednesday, it was an- j nounced today. About 1,000 executives of the food chain industry, besides rep resentatives of grocery manufac turers and suppliers, are expected to attend the four-day meeting, with sessions both in the Hotel Statler and Mayflower Hotel. Senator Anderson, Democrat, of New Mexico, former Secretary of Agriculture, will speak at the opening luncheon at 12:30 p.m., October 12 in the Statler. Purpose of this year’s session, officials said, is study ways by which members and their stores can ‘‘put more and better food on more table* for less money.” The association represents chain stores and super markets in Can ada and Mexico, besides this country.
