FINE CONTRACTING FOREMAN
FOR VIOLATING SAFETY LAW
John E. Burt, foreman for Christ
"Paschen Contracting Co., was fined
$25 by Municipal Judge Flanagan
yesterday for violating the safety act.
John Walt, deputy factory inspector,
testified how he found two scaffolds
without safety rails 25 feet above the
ground in the ironwork of the new
municipal pier.
Paschen's attorney pleaded hard
with the judge to remit the fine on
this "poor fellow, who was only the
foreman of the job."
"Judge, we have had Paschen in
here time and time again," Walt
said. "He always says that he has
ordered his men to comply with our
orders and so escapes a fine. This
firm is careless in complying with the
law. They had a man killed and an
other had his back broke in the con
struction of the Railway Exchange
bldg. This law is a very important
one and should be enforced."
"Twentyy-five dollars," said judge.
Christ Paschen paid Burt's fine.

WANT OPINION ON TAX LAW
Ass't State's Att'y Irwin Walker
today filed a petition asking the ap
pellate court to hand down an imme
diate decision on the mandamus pro
ceedings to compel Judge Fisher to
allow, the state to file information
against persons who have refused or
failed to file their personal property
schedules.
The appellate court has already
declared the misdemeanor clause
providing a fine of $200 for failing
or refusing to file their personal
property schedules as illegal Its un
favorable decision will therefore be
immediately appealed to the supreme
court, so a decision may.be had this
fall term.
If the supreme court reverses the
probable ratifying decision of the ap
