Judge LewIs today rendered a de
cision In favor of the petitioner In the
case of James Supple who asked for u
writ of prohibition against Justice of
the Peace J P McOmle of Murray to
prohibit tho latter from taking any
further action In a case wherein John
Sepplch secured a Judgment of J7
against Supple and a peremptory writ
of prohibition wan Issued against the
justice and Hupple was given Judgment
for his costs In the action
Supple alleged in his petition that
Justice McOmlo was without any Juris
diction whatever In the case ns neither
the plaintiff nor defendant were reel
dents of Murray and the contract sued
upon was not payable In Murray Sup
lie was a resident of Salt Lake City nt
the time the nation was commenced In
tho justice court and Sepplch was a
resident of Wyoming
A motion was made by Supple to dis
miss the action for want of Jurisdiction
