We have no exceptions to take to an v of the |»ositions of our correspondent excepting only hi«t af firmation that then- were errors in our statements. In bis ostensible enumeration, he did not clearly show when-in th« , y consiwt. Evidently what he was pleased to characterize as errors on our part were rather misconstriu'tion on his part of what we meant. We were aware of the two fact* be presents in the hiui[>e of rebuttal statements, and «1 i«l not «*ay anything to the contrary. The subject in not really in proper shape for discussion until it lain U'**n submitted to arid reported u]>on by engineers, and it was not within tin* « »|»«* of A brief tentative article to develop everv jioint in all its laarings. Hence the first of our statements to which lie adverts, ]*-rhapH, may require some amplification. There in a class of property that is enjoyed by a kind of prescriptive right, instead of an absolute one, by sufferance and not bv title. Water by reason of its quality of mobility caunot in all cases be classed an {lersoual pro]*rty, as will real estate. It is analogous to the right of common or privilege which is cujoycd by a man whose farm adjoins an unoccupied tract of public laud, pasturing his cattle thereupon, yet it is still more mvtola ble than the latter, and it has been decided -that owners who received l>enef»t from the presence *>r passage of a stream u|»on any ]»art of its course have a legal right to the j* r uianeney t»f that benefit. There is no suita ble or adequate water source that can lie relied upon to supplv our citv for twenty-five years to come, nearer than Cedar river, except the lakes. To go to the latter, though nearer, would require pumping ap|«aratus and forcing up hill. IVsides, there is a preference whenever |>ossihlc in drawing our supplies from the mountains above tis, whore it comes pure iadoq)i from the clouds m>tead of from reservoirs that lie U low. Ten or twelve years ag<> a considerable jkart of the water supply of San Francisco was brought m by way of the ocean beach and Fort Point in a wooden tlume. For such a Hume to Cedar river, a chief if not the priti ei|»ol item of excuse would be the luuiWr. Fifteen miles of box tlume of four sides, each two feet wide and two inches thick would require I,2TU,<U.h> feet ,>f lumber, whu»h. at $lO per M. would cost sP2,r*t>. The items for trestiing ami con struction would depend upon the estimates, but as t here is a good (all from Cellar river and nearlv uniform alighnmcnt by way of the valley, they need not be exorbitant. As the result of a hasty examina tion we are satisfied that the obnoxi ous term •'exclusive right" contAim-d in the proportion is only a bugl-ear as regards prohibition of other jar ties from furnishing water in the' city, eicept so fur us the right to condemn water proj-ert v within five miles is concered and possibly the privilege of furnishing the supply • required f<>r public us«n. The Coun cil has no more power under the city charter to forbid any party or parties for any jn-riod from selling water in the city than any other commodity. We do not wish to throw any ob- i stacles in the way of public enter prise but rather tc favor it, and we believe that this end can best be at tained by free and thorough exami nation and discussion. Our citizens are not so deficient in intelligence or fairness as to refuse to acquiesce in j anv reasonable plan for accomplish ing this much needed result when it is clearly shown to be the l*e*t that can l>e carried out.
