Mr. Burke appeared in behalf of the defendant, and Mr. Navarre for tbe plaintiff. The testimony showed that the plaintiff, the basbftnd of the defendant, had, on ac count of some domestic difficulties left bis wife. Just previous to this separation, which was some months ago, the husband and wife in question bad signed over a deed to a farm locat ed somewhere down the Sound to « third party, from whom they obtained •osae consideration. But en agreement was entered iuto at tbe same time, be tween tbe three parties, tbat tbe deed ia question should not be turned over to the third party, to who .a it bad been virtually transferred, only on certain conditions, and with the consent of the two first parties concerned. With tin* understanding the deed was then taken to Schwabacber Bros. &. Co.'# atore and deposited there by the husband of the woman, accompanied by the tbird party to tbe transaction. It was left there on condition that it should uot l*e given up without the former's consent; or his request or order. But a short time ago bis wifo wrote an order on Messrs. SJiwabacber Bros. Si Co. for the deed and signed her husltanl's name to it. Tbe third party took the order, presented it at Schwabaohcr's aud got the deed. Tbe husband was incensed when be learned of this, and had his wife arrested for forgery. The testimony in the case showed that the wife bad written the order and signed ber haslwnd's name to it; but this of fense was mitigated considerably by , the feet that she had always done a'l her husband's writing, and had used I his name many times before on orders and other written instruments, with- j out any 'objections ou bis part. But the defendant was dismissed aud ex- I ooerated on the (round that a wife ' cannot be deemed guilty ot forgery for siuiply using her husband's name, as tbe taw supjmflea the husband and wife to lie one, and that ia covcrtare she has a perfect right to use her husband'* . mine unless it is to tbe injury of a third party. During the trial the court room was orowded with a throng of curieus spectat<vn, to wbotn the case became in teresting on account of tbe somewhat romantic circumstances connected with it. SOME UEQIIEED AMENDMENTS- There should ho some ordinance enacted by our county authorities forbidding the UM of the public highways as cattb yards and deposits of manure. On account of the very muddy condition of the streets considerable difficulty was experienced in moving it down. During the day three trips were oiade up to Steele's place, and a go»*i load of railroad iion taken along each time. The little engine works to a charm, ami will serve a valuable pur pose for such jobbing work ami in mak ing up trains The new first -class locomo tive, purchased for the road so.ne mouth* ago u t<*> heavy aud valuable for such work. We were in error the other day. however, in stating as we w«re informed, that the engine had been purchased for the Walia Walla road l»y Mr. Col man, when, in fact, it had uot be?n. Messrs. FiXE HAY. —Some of the finest hay | we have ever seen in the Territory was shown us yesterday at Messrs. Craig A Marshall's establishment—a lot of 150 i tons,—which they have just received from Mr AI vord's farm on White river, and have for sale. The hay is of heavy timothy grass and cured in such a man , n«r as to irat>art to it a bright fresh 1 look, and still better, it is entirely free from weeds. Such hay must certainly always be in good demand at remune rative rates, und it would bo well for other of our farmers to emulate the ex ample of the producer in th's instance, and raise a superior quality of hay iu st» ad of the weeds and trash that are cut annually front many farms here about ss.
