SEC. 5. The Judge authorized to hold the Courts herein provided for oliall appoint a Clerk for each of said Courts, slid such Clerk shall hold his oflh o during the pleasure of said Judge and with the consent of said Judge he may appoint one or more deputies. That Clerks snJ Deputy Clerks heretofore appointed ami acting in District Courts held at any of the plaoes designated In this Act. shall remain in oftlco until rem >v» ed t-y said Judge, and the bonds given by them as such Clerks or Deputies shall remain in force during their term of office. Tbe Clork or Deputy Clerk of Courts herein mentioned, hereafter appointed shall, beforo enter ing upon the duties of bis office, take an oath t«> faithfully perform such duties and in addition thereto hw shall give n lioi.d with sureties to tho T«rritory, in such sum ns the Judge appointing hiui shall require, conditioned to faithfully account for and pay over to the person entitled thereto all sums of money that may cotue into his bauds hy virtue of bis office. Such bond must lie approv ed by tie Judge appointing him. Any person aggrieved by the omission of sucli Clerk or Depuly to fultill the condition of his bond, has a right of notion in his own name against such Clerk and his Deputies on their official bond for any dmi.tgcs he may have einttainrd by reason of such omission. SEC 7. The offices of tho Clerks of tho Courts established by this Act, shall IM» at the places where said Courts are held and they shall be kept open at all reasonable bouts. Sec. 8. Each of said Courts shall be provided with a teal, if one is not already provided. SEr. 9. Writ» of error*, bilis of ex ception* aud appeals shall bo allowed in all cases from the final de< issons of any of the Courts established by this Act. to the Supreme Court of the Territory under such regulations as may be pro scribed by liw. Sec. 10. Crimes and misdeincat.ors under the law of the Territory shall bo prosecuted and punished in the Court having jurisdiction in the county whiru the offence was committed, unless a change of venue is ordered. SEC. 11. If any term of any of the Courts liert in provided for is about to cud without dispatching all the business of such Court, the Judge thereof may, bv an order entered of record, adjourn the holding of such Court to any future dav on which he is uot required by law to hold a Court at >uin« other place ar.d all causes on tfto docket of said Court* uot otherwise disposed of shall stand contiuued to such adjourned day, aud if the terms of any of such Courts have ended without dispatching all the bus iness, or >f theie be a failure to hold any term, or if thero is much business accumulating in such Courts the Judge of the same may by a warrant, directed to tha Clerk, appoint a special term of Cocrt. The Clerk shall enter the war rant in tbe journal of said Court. At inch special or adjourned tens, any i civil Oiuse may bs tried by consent. SEATTLE, WASHINGTON TERRITORY, WEDNESDAY, NOVEMBER 20. In designating the Courts herein provided for it shall be sufficient to designate them as "Tba District Court holding tertas at ," filling the blank by the name of the placa in which said Court is held. This Act also fixes the time of holding District Court* in the Third Judicial District, any law to the contrary not withst mding.
