On their petition for the diauovnry. tha plaintiff* claimed that of the alack of the Oregon Steam Navigation Company, acquired in June, 1879, and on March 81, 1880, the Oregon Railway and Navigation Company owned or controlled a four fifths interest; that the defandanta* bonda and stocks ware leaned largely in payrr- ♦ of the Oregon Strain Nav igatioi upany stock which it re quired, ...d that it bad little other property, that the fact of iu not being able to buy all thia atoek at its own price cauaed tbe purchase by it of all that company's property on March 81. 1880, by proceedings of the board of di*sctura of tbe two fnimjenlaa. for 92.800,000; that tha defendant had atnoa e»umed te own and oootrol ita property and fraachiae, and for theae reasons the sale was a ebam. They claimed that before going ta Mai they most make discovery on what tarma tha Oregon Railway and Navigation Company acquired tbe dock of the Steam Navigation Company.
