I he following is the fuii text of the decision of Judge <»r«-«*ne at Port Town send. in the rase of Jack man vs. vnn. wherein he consider* at length and definitely pronounces upon tbe enact ment of the late Legislature amend.-' tory of th»* exemption law Defendants, in an affirmative de fend, claim the exemption of certain prop* rtv they de-*:nb«. Tbev claim tbe nemption. by virtue of the provisions r,f section M" of oar Code, as enact- d by tie Legislature of 18SL Bat plaintiffs contend that the section named has been so changed by oar lust that no exemption what- j ever can Dow be bad under it. Thry make no other point upon the demurrer and concede that if they are wrong in this, the decision ««u<t t<e against them. The change in the law is suppos* d to , have tx-en wrought by an act, approved November I**l, entitled "An Act to amend Section M" of the Code of Wash ington,'" the first and material section of which is as follows "Section 1. Beitenarted by the legis lative Assembly of the Territory of Washington, That Section M 7 of the j Code of Washington. I**l, be amended . to read as follows To H teamster "r drayman engiged ID that business for the support of himself or faruilv. his team, consisting of one span of hors< s, mules or oxen, or a horse and male. wrh harness, one wagon, truck, cart or lirav." Now, when a legislature uasses a bill it intends thereby to do something, j What in any instance it has done is to l>e gathered from what it intended to * do. and that i* to be ooll#ct«d from the ! language it employs and from the rel I i tion the langu ige bears to previously ] existing law. Both bv title and enact- j ing claii'e of this *ct of lPrii the legis lature h is anmistakeably declared that its intention was, not to repeal anv \ thing, bat to amend something. But if. j as plaintiffs insist, the ruaHing which . the act provide* were to be substituted : tor the entire section 1547, tben ti.tre 1 would be. übt an amendment, but a re- j peal. For the new reading, lie ng in structure a dependent and qualifying clause, wonld stand alone and be sense lesH, having no principal c anse on which to depend. And to substitute such a senseless clause for the fensil.le section would l>e to substitute nothing for something, and be in effect a repeal of the section. By the amendatory act it is not said thi.t section H47 shall be so amended "so as to road in it* entirrty, as fol lows bat it is said it shall be amend ed "v>an to ruatl as follows." In what part is it so to read ? Or. is it so to read as to the whole V Manifestly not as to the whole, for thii would work a repeal, contrary to the tenor and evident spirit of the act. Therefore, it is so to read as to some part. As to what part ? Why, of course, as to that part for which it would lie a natural, fitting and sensible substitute,hf there beany such; and that there is such is to lie presumed until a diligent examination has dem onstrated there is not. Hefernnßto sec. 1447 we hud, on a more casual inspec tion, that the amendatory reading is an apt and most appropriate sabstitute for the twelfth subdivision of the section. Carefully scanning that subdivision, and comparing it with the preceding subdivisions, we discover further that a te mister's exemption was liablw to be considerably in excess of what others could claim, and that iu order to equal ise things and give symmetry and fair ness to thw schedule, just such a substi tute was required. There can ho no reasonable (mention, then, it seems to nit*, as to the intent of the legislature. Anybody of any sense, who is not a lawyer or Judue. can tell at a glance what that inteut is. When a man becomes a lawyer he does not have to lose his wits, nor does a J mine have to l>« a fool. 1 desire never to be one of those Judges who, when they discover in legislative proceedings a clerical mistake, madvertenoe or blun der. will push it to extremity and to an unhappy effort at expression a sense nnd j>ower palpably never in tended, and permit the awkwardness of a phrase to work rum and demolition for the |Nior. Demurrer overruled. A PltOL, " Some folks is jist too smart to live," said the old man, as he puffed hard at Ins clay pi|>e aud wiped a tear from the end of his nose. "Anybody been trying to swindle you V " Wal, it Umks that way. A New Yorker came dowu aud Isiught a farm next to me, aud he hadn't been there a week before he proposed to mo a pool." "t)u what?" ••(in milk and butter. He proposed to put lit fifteen head of cattle agiu fifteen of mine, hire the milking done, and divide even on the sales of the butter." " That looks fait." "So it does, and 1 was ready to go into it, when my old woman hinted that I'd belter go over and see his stock." " Well?" " W.tl, there was fifteen head, jist as he said; but bless my stars if he hadn't counted lu a bull, two old st tgs and a steer to offset four of mv cows, whioh average f> urteeu quarts of milk a day. I've read a heap about pools, but this is the Highest that 1 ever come to haviug one lute me." Tun- Okfoon Shoht Link.— The Ore gou Short Line is nearly completed from Oml«n to Itoise City.
