When approached by the Daily Press
correspondent yesterday, Congressman
William A. .Smith did not attempt to
conceiaj the fact than tihe trip would be
undertaken, and spoke of the expedi?
tion very willingly.
"Yes, we are going to Havana as
he said. The trip i,-: made to satisfy
the individual curiosity of the member's
of the puny, Mr. Smith explained, and
they will not act in their official capac?
ities while in Cuba. The expenses .jf
fitting up the staunch liittle yacht An?

proprietor of the New York Journal.Mr.
W. P.. Hearst, and it is a; his request,

Congressman Smith was not incliu'e.l,

LATER?The Anita sailed fo.r Ha?

THE NKW EUBCTORAL BOARD.
Change in the Names Recommended a
Subject of Comment.
The appointment by tire Legislature
on Tue,-.lay of the electoral board for
Fjllzuibeth City county confirmed the
report that was mentioned tn the Daily
Press several days ago to tihe effect
thail an effort was being made to sub?
stitute ttiv name of Mr. E. M. Tennis
for thvtt of iMr. George A. -Schmelz, who
was recommended by the county exec?
utive eommittee. as one of the members
oif the b.ard. ?
The Iboi.urd Us named comslsts of
Messrs. 'Segar Whiting, T. H. Parra
m ire and E. M. Tennis, the two former
gentlemen having been recommended,
along with Mr. Schmelz, by the county
ox e cut i v e c.i > m m it Kse.
Mr. E. E. Montague, uho floater dele?
gate from this legtetatlve district, was.
f,ii- some reason, opposed to the ap?
pointment of Mr. Schmelz as a imemb^r
at tihe leard, and at his instance the
name of Mr. T. nnis was smlbstltuted
?for that of .Mr. Sch.melz. A member of
the district! committee. w.ho went to
Richimond to investigate the truth of
the report that the change in the rec?
ommendations of the executive com?
mittee would 'be made, learned from
Mr Montague that tihe'rumor was Well
founded. Mr. iMontague stated as his
ireason for taking this position that he
desired to eliminate the ill .feeling that
was aro'US>ed in the party during tihe
last campaign, and restore entire har?
mony and unity.
I Among the hardest workers for the
election of Mir. 'Montague was Mr.
Schmelz, 'and the unexpected -develop?
ment in the electoral board matter was
the subject yesterday of considerable
comment. , ,
The change In the electoral board
throws tue balance of power in the
hands of those who opposed Mr. Mon?
tague's nomination, and bis action is
iregardied in some quarters as a viola?
tion of his obligations to those -who
fought 'for him wihen he most needed
supporters.

A C arney M. T. Hughes Appeals FV*r a j
"Writ of Error.
On Tuesday Aittorney M. T. Hughes
pr.-s- nt'i d to Judge .1. G. Blacksume,
of the 'Circuit Court, the petition of T.
T. 'Edwards, for a writ, of error from
the judgment of the County Court
ivn Ivied against him in. January, by
wihich he was sentenced to serve it wo
years and six months In the peniten?
tiary.
The petition is albly drawn, and re?
cites three 'reasons for the granting of
the writ. The fin-t ground assigned in
the petition Is set forth in the first bill
of exceptions, claiming that the Coun?
ty Court was in error in' granting Live

enth, eighth and ninth instructions to
the jury, a skied 'for by the Comimon
wealth. Num<irm?s cases aire cited in
the petition to sustain the claim of er
r-. IT.
The second reason for the issuance of
a writ of error ii3 set forth in bill of
exceptions No 2, and reference is made
bo the certified copy of the evidence
ami the law governing the case.
The other cans.- f.-r the applicant ion
for the w rit Is that the court erred in
of, nruling the motion to arrest judge?
ment for errors alppeis ring on the face
of the record, in which case tihere is no
necessity f.-r a bill of exceptions. The
'first error in the rveord is its failure

That the record dn?es not show that the
jury was summoned by proper author?

and the .last Haw is uhe fact that tiiie
record omits to state that tihe same

It is protoaible that the norm of the
Circuit 'Court of Elizabeth city county
will lie changed after the first of July
to the Last on ithe list. The docket is
larger at present than it has been for
many yeairs, and Oho change will give
the county a longer term than the oth?

It will probably be necessary to bold
