Tho same plaintiff and the first-named defendant previously brought a bill to cancel tho same deed ngainst Charles T. Guliolc, "the former guardian of Antoino A. Doiron, on tho ground that tho deed was a forgory. It was on trial that tho doed was not a forgory, but that tho t'y nature thoroto was by Agatha T. Nott's own hand. Now tho deed is attack od on tho ground th'atAgath T. Nott, wife of tho plaintiff, fraudulently executed tho doed in question. It is assorted that previous tojtho marriage of tho parties in 1889, Agatha owned a piece of land at Wailuku with a dwelling house and other buildings standing thoreon, which proporty sho acquired by inheritance from her former husband, Ionnis Biguour, deceased; ''that her ownership of tho said propoity was known to the said Thomas Nott provious to the said morriaco and was pait of tho inducement thoruto; and before said murringo and in contemplation thereof and while tho said Agatha T. Nolt was receiving attentions from the said Thomas Nott as an accoplod suitor, in view of such marriago, tho said Agatha T. Nott fraudulently executed and dolivorod a dojd of con veyance of tho said property to tho said Antoino A. Doiron;" that the doed vms not recorded till about May 23, 1890; that the said Thos. Nott had no knowledge of Until after the Bolcniniztt'.m of tho marriago; that the sa'd Antoino Doiron novor entored into possession of tho proporty; that Doiron nover paid tho consideration, fiftoon hundred dollars, or any part thoroof, to Agatha T.
