LEXINGTON MAN IS SHOT.
Menaugh and Simmons Scufie;
the Latter May Die.
REPUBLIC SPECIAL.
Lexington, Ho., July IS. Ennis Simmons
was shot and perhaps fatally wounded by
Loren Menaugh this morning. The shoot
ing occurred in a restaurant on Tenth
street. Different stories are told as to
the cause of the trouble.
.Menaugh claims the shooting was acci
dental. Ho says they were engaged in a
friendly scuffle and he did not know the
revolver was loaded.
Simmons v. as taken to the ofllco of Doc
tori, Tucker and ITtedcndall, where the
wound vtas dressed.
Simmons says the scuffle began in a
half friendly ay. but gTew to be serious,
and claims that Menaugh shot him inten
tionally. Menaugh was arretted and the
case is being investigated.
Faint Spells

TO TAX LEVY.

ment Is Made.
Mayor Edward S. Hart and City At
torney Sam D. Hodgdon of Webster
Groves appeared before tho St. Louis
County Court in Clayton yesterday and
declared that. If they could not bo ex
empted from a special tax levy of 15 cents
on the JIM assessed valuation, they would
attempt to have tho county organized un
der a municipal township form of govern
ment. Under this plan the taxes collected from
a certain bection would be expended for
improvements in that section Instead ot
being put upon roads that tho taxpayers
never use.
Incidentally it would deprive tho County
Court of tho power to appoint road over
seers which at present is valuablo to
build up a political machine at the ex
pense of the public road fund. Under the
township sjstem the read overseers would
be elected by the citizens of the district
In Thlch they work.
The Webster Groves officials have been
trying for several jears to be exempted
from the pament of the special road tax.
Their constituents pay the general tax
without a murmur, even though none of
the funds collected are ever expended on
the Improvement of the roads within the
corporate limits of the town.
They say. In fact, that they would not
object to paying the special levy if tome
of tho funds were devoted to the town
streets, but object strenuously to paving
for road improvements in sections of the
county in which they never travel.
St. Louis County Is at present composed
of live townships, but they are not. it is
said, known as municipal 'townships, but.
Instead, are mere territorial subdivisions.
The other incorporated towns. Kirkwood,
Ferguson and Florissant, also contribute
to the road fund, but none of the money
is ever spent within their limits, as the
County Court has boen advised that it
would not be legal to do so.
To organize the county under the town
ship form of government, it is necessary to
first petition the County Court, after
which it Is mandatory upon that body to
submit ths proposition to the voters at the
flrst regular elecUon thereafter.

The -will 6f Mrs. Lina Hcrtter was filed
for probate yesterday. She directed that
her husband's library be given to the
Reverend Frederick Dletz of I'aar, near
Strasburg, Germany.
She left 50 each to the General German
Protestant Orphan Association and the
German Altenhelm.
She directed that a monument be erect
ed In her burial lot In Bellefontalno Ceme
tery. She divided her Jewelry among her
relatives and left several legacies ranging
from $50 to $300 to relatives and friends,
and directed that the rest of her estate
be sold and tho proceeds divided into two
parts, one to contain $700 more than the
other. ,
Of the larger part. $7,000 is to be hold in
trust for the benefit of the two children
of her deceased brother, and the rest for
the benefit of her niece, Charlotta Mat
tick. The other part is to be divided among
the widow and children of Frederick
Dletz. who reside In Brandenburg. Prus
slti; the children of Julia Tropf of Franken
thal, Bavaria; the widow and children of
Julius tiles ana Ann -Mueller, nee RIes,
cousin of testatrix's husband.

"Found dead, washed up by the sea In
Bigbury Bay. Devonshire," was the ver
dict to-day of tho Coroner's Jury in tho
Inquest on the body of F. Kent Loomls.
The evidence was not very conclusive ami
wholly conjectural, as pointed out by the
Coroner when lie advised this open ver
dict, adding that although death was
caused by a blow there was nothing to
Justify the suspicion that it was foully
administered.
Consul Stephens of Plymouth has charge
of the body, which is in a fair state
of preservation. It will bo embalmed and
slipped to the United tSates for burial as
soon as practicable.
Tho Inquest threw the picturesque little
Devonshira village of Thurlestone, on the
shores of Bigbury Bay, Into a state of un
wonted excitement. The court, over which
the County Coroner, Doctor Sidney Hack
er, presided, was somewhat late In as
sembling. In consequence of the delay In
carrying out tho olllclal medical examina
tion of the bod.
This was conducted by two local doctors,
whoso testimony v-as to tho effect that
there was a contused wound below and
behind the right ear. indicated by the
extravasation of blood in the scalp and a
rupture of the covering of the brain There
was also a geiural bruise. Involving the
scalp and tho integununt of tho bram on
the lft side above the car. Both in
juries, in the doctors' opinion, were caused
before death.

for August and September
as Now.
At a meeting of representatives of the
Southwestern lines at the office of Joint
Arent Ilannegan. Missouri Trust build
ing, to-day. rate from the Southwest to
St. Louis for the months of August and
September will be considered.
It is expected that the same rates ap-
fillcable at the tame periods as are now
n effect will be adopted.
The clergy arrangements will bo con
sidered and the rules and by-laws will be
revised. A new Executive Committee will
also be appointed.

Chicago. July 18. Considerable uneasi
ness exists In railroad circles over the
threatened passenger rate-war in connec
tion with the National G. A. R. Encamp
ment. The Michigan Central Is dissatis
fied with the rate of $17.75 made by the
differential lines, nnd It has now an
nounced that "if any line uses a lower
rate thin $20.3. Chicago to Boston anil re
turn, the Michigin Central's rate will be
as low as authorized or In effect by any
other line."

About 60,000 Persons Kegister
for Homestead Lands.
Omaha. Neb.. July 18. The Chicago and
Northwestern Railroad ran two specials
in addition to lt regular train to Bone
steel and Fairfax last night and to-day,
carrying more than 2,000 men and women
who propose to register for lands In the
Rosebud Reservation, recently opened for
homestead entry by the Government.
The rush to the Rosebud Increases as the
time for registration expires, and it is esti
mated that about 60,000 persons have thus
far registered.

Two Wives Keek Divorce.
Catharine Fauth filed suit for divorce in
the Circuit Court yesterday against Fred
erick Fauth. charging that he struck her
and deserted her. They were married De

mony. Bertha Mosch charges that her husband.
