JJorris, who died recently in Mississippi, is from the pen of his pas tor and was published in the Winona (Miss.) Times: "Mr. H. E. Torris was lorn in Montgomery county. Miss., October 27, 1852. and died at his home in the same county, October 12. 1901 age 48 years, 11 months and 15 days. He was mar ried to Miss Alice Kindred about 1S75, with whom he spent twenty-six years of happy married life, when he was summoned up higher, leaving a loving wife and ten children, hut not without hope. "At the age of 24 he embraced re ligion and united with the Baptist church, and was afterward chosen deacon, which office he filled with credit to himself, church and com munity. "The writer was very intimately acquainted with him for more than ten years, and his pastor for eight years, and all this time his friend and neighbor. "He was one of our truest men, and from the start. Irreproachable as a Christian man. Having been a mem ber of the Missionary Baptist church for many years, he was rarely over missing from the regular meetings of his church. He was true to his church, and this means true to his Master. He, remembered the wants of his pastor. Grounded and settled in the faith of the gospel, he held by his church and he never gave encourage ment to any floating errors of the day. He was a man of deep convictions, and his life was governed by what he be lieved to be true. A test of the constitutionality of the law passed by the late legislature, pro viding that nine jurymen, may bring in a verdict in a misdemeanor case ?s a I Kiu t to be submitted to a test. It will be a consequence of the ver-lkt of the jury which found Deputy Con stable Berryesa guilty last Wednesday night, of exhibiting a deadly weaion to W. H. Kastwood in a rude and thret enlng manner. The contention of Rerryesa's attor neys. Flu Hard and Alexander, is based upon two grounds. One is said to be a decision of the United States su preme court in a similar case in which it was h(Md that the defendant because of his residence in a territory was en titled to the right of the benefit of a unanimous verdict as provided for by the federal laws. The other ground was that the case against Berryesa could have been tak en cognis;ance of under the common law in which case the law making a three-fourths verdict applicable would not apply. A motion for a new trial on these grounds will probably be made today. Children will be admitted to the Good Templars benefit, Oct. 29th. for 25 cents. Reserved seats may be secured at the Adams Hotel pharmacy with out extra charge. Mr. and Mrs. Ryan left for the north this morning accompanied by Governor Murphy who is going to Ash Fork to meet Governor Otero of New Mexko and a delegation from t hat territory who are coming to attend the statehood convention here tomorrow. DAY OF ARRAIGNMENTS Little Else Happened in District Court Yesterday. HON. THOMAS RYAN First Assistant Secretary of the Inte rior Visits Phoenix Hon. Thomas Ryan, first assistant secretary of the Interior whose coming was announced by the Republican ar rived yesterday morning accompanied by Mrs. Ryan. They visited the India:! school in the forenoon and with that Geo. McDonald, who was indicted on Wednesday aTternoon for the murde. of K. J. Gardner, was arraigned and given until tomorrow to plead. John Ru'oensteln was arraigned again for the murder of Amos Nye and Pedro Johnson. Rubenslcin had been arraign ed under previous Indictments for the same crimes. Rubenr.tcin claims that his shoe soles are being worn out by having to climb the iron starcasing of thi Jail to attend this series of arraign ments, an anticipatory punishment which is neither exemplary nor retalia tory, ne will plead again on October L'6. On the same date Juan Flores will plead again. M.C. Berdugo, who was cnarged with association with B. IVralta in the stealing of a check from Harry Azut, withdrew his plea of not guilty to the Indictment and pleaded guilty. Th check was returned to Azul oy an or der of the court. The case of L. Espinosa set for trial yesterday was continued until today. The grand Jury was in session all lav evidently having several cases under consideration, but no report was submitted.
