The proprietor of the Capi tol chop house visited Justice Burnett yesterday morning with the object of ascertaining if there was any way ii which he could recover from Lopez th? price of five oyster stews and live "T" bone steaks which he had devoured at one sitting the night before. The jus tice was at first of the opinion that the law furnished ro relief for the de vastation that had been wrought in his establishment but when the proprietor told him that when he undertook the preparation of this solitary banquet, and up to the time when Lopez shov ed hi3 crfalr back from the table and remarked that what he had eaten he thought would stay his stomach until breakfast, he had reason to believe that he would get his pay for his trouble as well as for the raw material. After some words Lopez expressed a. willingness to pay for the oysters but he insisted on regarding the "T" bone steak as side di?hes apurtenant to the ! oysters. The proprietor refused to set ' tie' on that basis, and Lopez re'used to settle on any other. Upon this show ing a warrant was ippued for the arrest of Lopez In which it was stated that he had ob tained "five 'T bone steaks and five oyster stews, fraudulently, designedly and with malice aforethought." He j was arrested and showed a disposition to fight the case. He objects to the ise ; of th-3 words "fraudulently" and "with malice aforethought." He is willing. ' however, to let the word "designedly" ; stand, admitting that it was by no . mere accident that he undertook in this ccmprchenr ive manner to satisfy the par.ga of hunger.
