A con tinuance was asKfd for bv the defense and was granted on the condition that tiie defendant should pay $30 not to be recovered under any judgment that may be rendered. This money is for the payment of witnesses who . had come to the trial. MAY EE HEARD AGAIN A motion for rehearing was tiled in the office of the clerk of the supreme court yester day by the appellee in the cast of The Phoenix Right & Fuel against Thomas D. Bennett appealed from this county and in which the judgment of itv lower court had been reversed and 'i new trial ordered. The opinion in this case was handed down at the last meeting of the court. BOARD OF TRADE MEETING. The directors of the board of trade met last night for their regular month ly meeting and decided upon a cam paign for securing new members. The Washington Tost, which came to Phoenix yesterday contained the fol lowing regarding the visit of Mr. R. A. Fowler to the Capital: Hon. R. A. Fowler, president of the board of trade of Phoenix. Ariz., and representing the Water Users' association and the j Tonto road committee, is at the Ra-1 leigh. Mi. Fowler is in Washington for tha purpose f pushing the en abling act granting the cities of Phoenix, Tempe and Mesa the power to vote bonds to construct what is known as the Tonto road. Afte. reaching Washington yesterday Mr. Fowler consulted with Delegate Wil son, of Arizona. 'The people of Ari zona are unanimous fcjr statehood, and they want separate statehood, too, and no junction with New Mexico,' said Mr. Fowler. 'Less than 2 per cent of the citizens of the territory oppose the statehood movement, and they rep lesent th least- progressive element.
