James J. Duncan Succumbs To At
tack of Tuberculosis.
James J. Duncan, who is believed
to have come to Phoenix from St.
Paul. Minn., died at 7:30 o'clock yes
terday morning in the city jail where
he had been given lodging, upon his
representation that because of being
afflicted with tuberculosis he had
been refused a room at a number of
places where he had applied for
lodging. Evidentally hoping to keep
his real name from being entered
upon the police records he registered
as A. Richards, but papers found in
his pockets revealed his real name
as well as the fact that he was a
member of the Eagles fraternity in

lice station he nott only manifested
great weakness but admitted that he
had been drinking heavily for the
past few days. He had received
money from home and the local
lodge had helped him. The secretary
of the Eagles upon learning of the
presence of Duncan in the city jail
undertook to find a suitable lodging
place for him, but thought it best
that, he remain a day or two in the
city jail until he had gained enough
strength to warrant his removal.
Yesterday morning Duncan told
City Jailor Perrin that he believed
he could eat a little breakfast. Per
rin hurried out and had a breakfast
prepared that he felt would be ap
petizing to a sick man, but when he
returned a few minutes later, Dun
can was dead. Coroner Johnstone
impanelled a jury which returned

Motions in Famous Zeckendorf
Steinfeldt Case Dismissed.
Asserting that it had no juri.sdic
tion in the matter, the supreme court I
-f the state of Arizona yesterday re
fused to interfere in the now' fam
ous Zeekendorf-Steinfeldt case that
was recently decided by the supreme
court of the United States, so that
the motion of the defendants and
appellees was denied and dismissed.
This case hits been prominently be
fore the public for the past several
years both on account of the prom
inence of the parties and of the
amount involved in the suit.
It was remanded from the supreme
court of the United States with in
struction that the supreme court
hear certain motions but the state
supreme court denied that it hart any
jurisdiction in the case so that it will
now go back to the trial court.
