accession of William and Mary in
; England, the province Of New York
was agitated by a strife between the
rival political parties, so hitter that
the rights of the defeated were gross
ly violated and they were not always
safe in their liberty and their lives.
In IfiflS Lord Bellomont was sent to
this country as Governor of the prov
ince and he favored the party that
had been opposed to .lames II. This
support kept the two parties evenly
drawn and thus both were protected,
but when Bellomont died, in 1701, the
ancient animosity of the rival fac
tions were revived with the utmost
zeal and fury. Information being ro
ceived that Lord Cornbury was to
succeed the Bar! of Bellomont, the
aristocratic party, n"c in the minor
ity, took measures to secure the new
Governor to their own interests.
Nicholas Bayard, a prominent mem
ber of this party, made scandalous
charges of bribery, of public plunder
and oppression against the Lieuten
ant Governor, the Chief Justice and
the Assembly, and reflections were
liberally east upon th" memory of
Lord Bellomont himself.
When this cam.' to the knowledge
of Nanfan, the Lieutenant Governor,
he committed Bayard to prison as a
traitor. Thus was the leader of the

A part of the jury insisted that
they had a right to deliberate alone,

The Indictment set forth that the
prisoner, on the loth of December.
1701. "falsely, maliciously, etc.. used
divers indirect practices and endeav
ors to procure mutiny and desertion
among the soldiers in the fort, and
drew numbers of them to siitn false
and scandalous libels against his
majesty's government.'
The prisoner, upon his arraignment,
pleaded not guilty, and desired thai
he might be allowed two clerks to
take the minutes of the trial. The
request was denied. The prisoner
then sent a petition to the court ,
which he set forth the Injustice and
the irregularity of the proceedings
against him. of course the petition
had no effect.
The Solicitor Genera then made an
introductory harangue to the jury, in
which he declaimed against the Knt
lish ami French inhabitants of the
colony, including the principal Dutch.

Testimony against Kayard was given
by Samuel Clows. Peter Odyre, W.
Richardson, John Bashford and others,
and at its conclusion the counsel for
the prisoner addressed the court and
jury in his behalf, followed by Es
nuot, his other counsel. Several wit
nesses were then called in behalf of
the prisoner, among them the minis
ter of Trinitv church, who testified
to his exemplary character and his
.ttachment to the cause of the King.
The Chief Justice then charged the
jury, and they retired and for several
days they could not come to a de
cision. The Chief Justice then pro
nounced the sentence of death, but
this was not carried into execution

Cornbury announced himself the
