ORDINANCE NO. 3 An Ordinance Requiring Owners and Occupants of Buildings, Grounds and Premises Within the City to Remove Therefrom and from the Sidewalks Adjacent Thereto Dirt. Debris, Rubbish, Garbage, Weeds and Brush, and to Keep the Same Free and Clear Therefrom:' and Providing a Penalty for Failure, Neglect or Refusal So To Do: and Providing That. Upon the Failure, Neglect or Refusal So To Do, the City Manager May Cause the Re moval or Destruction Thereof, at the Exepense of Such Owner or Occupant, and That the Expense of Such Removal or Destruction Shall Bo a Tax Lien Upon the Buildings, Grounds and Premises. BE IT ORDAINED BY THE COM MISSION OF THE CITY OF PHOE NIX, as follows: Section 1. Section 2. Should any such owner or occupant of any buildings. grounds or premises within the city fail, neglect or refuse to forthwith remove from the said buildings, grounds or premises, or from the sidewalks adjacent thereto, any dirt, debris, rubbish, garbage, weeds or brush; or should any such owner or occupant f:ul to keep and maintain any such building, grounds or prem ises, or any sidewalk adjacent there to, free and clear of any dirt, de bris, rubbish, garbage, weeds or brush, then the City Manager is hereby authorized and directed to remove or destroy, or to cause to be be removed or destroyed, any and all such dirt, debris, rubbish, garbage, weeds and brush, at the expense of such owner or occupant; and tho said City Manager is hereby directed to forthwith prepare a verified state ment and account of al lthe ex penses incurred in or occasioned by or incident to such removal and de struction, or either of them, and to tile such verified statement and ac count with the City Assessor and ex-officio City Collector. Section 3. All such expenses In curred in connection with, or inci dent to, such removal and destruc tion, or either of them, and as fixed and determined by said verified itemized statement and account filed with the Cty Assessor and ex-offlcio City Collector, is hereby declared to be and is hereby made and fixed a3 a tax lien upon such buildings, grounds and premises; and shall lie : charged and assessed upon and I against the said buildings, grounds i and premises, and shall be collected ! at the same time and in the same manner as other city taxes are col lected. Sec. 4. Any owner or occupant of any buildings, grounds or premises within the city who shall fail, neglect or refuse to remove from any such j buildings, grounds or premises own ! ed or occupied by him, or from the I sidewalks adjacent thereto, any dirt, 'debris, rubbish, garbage, weeds or ! brush, or who shall fail, neglect or i refuse to keep and maintain the , same or any of them free and clear iof any and all dirt, debris, rubbish, garbage, weeds or brush, shall also be guilty of a misdemeanor, and j upon conviction thereof shall be pun , ished by a fine of not less than five i 5)nor more than fifty (50) dollars, . or by imprisonment in the city Jail j for a term not exceeding thirty (30) 'days, or by both such fine and im , prisonment. j Sec. 5.
