Pursuant to the Provisions of the the Improvement Act of 1912, and more particularly Resolution No. 35, of the Commission of the City of Phoenix, Maricopa County, State of Arizona, adopted the 31st day of July, 1914, directing this notice, the Commission of said City of Phoenix, invites and will receive at the Office of the City Clerk, in the City Hall, up to five o'clock P. M., on Tues day, August 18th, 1914, sealed pro posals or bids for the following work or improvement to be done in accordance with the plan, profiles and cross sections for said work on file in the office of the City Engin eer of the said City, and further in accordance with specifications on file in the office of the City Clerk of said City, all of which is more par- Phoenix Trust Co. That the roadway of the alley of Block Ninety (90) of the Original Townsite of Phoenix, except that portion occupied by a cement con crete gutter, be graded and paved with Bitulithic pavement. 2. That the said contemplated work or improvement in the opinion of the Commission is of more than lo cal or ordinary public benefit and said Commission hereby makes the costs and expenses of said work or improvement chargeable upon a dis trict and hereby declares that the district in said City of Phoenix bene fitted by said work or improvement and to be assessed to pay the costs j-nd expenses thereof is described as follows: All of Block Ninety (90) of the Original Townsite of Phoenix. All proposals or bids offered or filed shall be accompanied by a bond payable to the order of the Mayor of the City of Phoenix, for an amount which shall not be less than ten (10) per centum of the aggregate proposal. The Commission jt the City of Phoenix, reserve the right to reject any and all proposals or bids if it deems this for the public good and also the bid of any person who has been delinquent or unfaithful in any former contract with the Municipali ty, and shall reject all proposals or bids other than the lowest regular proposal or bid, of any responsible bidder. The plans, profiles, cross sections and specifications of the proposed work hereinabove referred to may be seen at the office of the City En gineer of the City of Phoenix. All proposals must be presented in a sealed envelope endorsed on the outside with the name of the alley for which the proposal is made. The said Commission has deter mined that serial bonds shall be is sued to represent each assessment of Twenty -five (25.00) Dollars or more for the cost and expenses of said work or improvement, said serial boruls to extend over a period end ing nine (9) years years from and after the second day of January- next succeeding the date of said bends, and payable semi-annually. Said bonds to be in the form and payable in the manner prescribed in said "Improvement Act of 1912." Reference is herehy made to the EituliU.ic Mixture License agreement of Warren Bros., Company, of Bos ton, Mass., dated June 15th, 1914, on file in the office of City Clerk of the Cliy of Phoenix. DECLARING THEIR INTENTION TO IMPROVE A CER TAIN PORTION OF MADISON STREET, AND DETERMINING THAT BONDS SHALL BE ISSUED TO REPRESENT THE COSTS AND EXPENSES THEREOF, AND DE CLARING THE WORK OR IM PROVEMENT TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND THAT THE COSTS AND EXPENSES OF SAID WORK SHALL BE ASSESSKD UP ON A DISTRICT AND PROVIDING THAT THE PROPOSED WORK OR IMPROVEMENT SHALL RE DONE UNDER THE PROVISIONS OF THE IMPROVEMENT ACT OF 1912. AND SUBSEQUENT AMEND MENTS. BE IT RESOLVED, by the Com mission of the City of Phoenix: Section 1. That the public interest and convenience require, and that it is the intention of the Commission of the City of Phoenix, to order the fol lowing work to be done, to-wit: 1. That the roadway of Madison Street in said City from the westerly line of Third Street to the easterly line of Third Avenue, including the intersections of First and Second Streets and excepting the intersec tions of Central Avenue, First Ave & Second Avenue, and including also private drives wherever shown on the plans hereinafter referred to, and including also such portions of inter secting streets as is necessary to form an easy approach to the pave ment hereinafter '.escribed, be graded and paved with Bitulithic Pavement. 2. That a combined concrete curb and gutter be built along both sides of the roadway of Madison Street from the westerly line of Third Street to the easterly line of Third Avenue, excepting at the intersection of streets, alleys and private drives and tho approaches thereto, and ex cepting also where a concrete curb has already been built and is in sat PETEV ABROAD-On isfactory condition as shown by the' 1 1 : 4-. .r,.v.rl . t a gutter only shall be built. 3. That a cement concrete curb be built along the edges of the pave ment at street intersections approach es thereto, and private drives ex cepting where curb is in a satisfac tory condition, on Madison Street from the westerly line of Third Street to the Easterly line of Third Avenue. 4. That a cement concrete gutter be built across the intersections of all private drives along Madison Street from the westerly line of Third Street to the easterly line of Third Avenue. 5. That a ditch- be dug in the parking on both sides of Madison Street between Second and Third Street ' excepting at the intersection of private drives. 6. That the Parkings on both sides of Madison Street from the Easterly line of Third Avenue to the Wes terly line of Third Street be graded level with top of curb from the in side of the curb to the outside edge of sidewalks or to the property line, if side walks are not in. 7. That corrugated iron pipes ten (10") inches in diameter be laid crossing Madison Street on the East side of Second Street, near the edge of the roadway of Second Street. That corrugated iron pipes ten (10") inches in diameter be laid under all private drives along the South side of Madison Street between Second and Third Street. 8. That cement concrete stand- pipes be built at the ends of the aforementioned corrugated pipe cross -ing Madison Street on the East siJe of Second Street, and that sheet mttal gates be set in said stand-pipes to control the flow of water through said stand-pipes. 9. That cement concrete pipes ten (10") inches in diameter be laid along both sides of Madison Street, from the aforementioned stand-pipes to a point five (5') feet East of the east line of Second Street and along Second Street from stand-pipe on North side of Madison Street to a point approximately fourteen (14') feet beyond the North property line of Madison Street. That sheet-metal gates be set reaching through the curb and that said gates be con nected with ten (10") inch cement pipes on boto sides of the Roadway of Madison Street approximately five (.V) feet West of the west lino of Third Street and approximately five (5') feet East of the east line of Third Avenue. , 10. That corrugated iron culverts complete with , Bulkhead structures be built across Madison Street on both sides of Roadway of First and Second Streets, and that corrugated iron culverts complete with Bulk head Structures be built on both sides of the Roadway of Madison Street from the aforementioned cul verts to a point approximately five. (5') feet beyond the corresponding property lines. 1L That Wing Walls and bases only of Bulkhead Structures be buill at the following locations to connect up with structures already in at Madison Street and Central Avenue, Four, at Madison Street and First Avenue, Four. 12. Section 2. That the said contem plated work or improvement in th opinion of the Commission is of more than local or ordinary public bene fit and that said Commission hereby makes the costs and expenses of eaid improvement chargeable upon a dis trict and hereby declares that the district in said City of Phoenix b-ne fited by the said work or improve ment, and to be assessed to pay the costs and expenses thereof is de scribed as follows: The South half of Blocks 3.1, 34, 35, 64, 65, & 66 and tf:e North half of Blocks 38, 37, 36, 63. 62, & 61 All in the Original Townsite of Phoenix. Section 3. The Oity Engineer is hereby directed to make a diagram of the district described hereinabove in Section 2 of this Resolution of In tention, to be assessed to pay tho costs and expenses thereof. Section 4. The said Commission finds that public convenience re quires that serial bonds shall be is sued to represent the costs and ex penses of such work or improvement and said Commission determines that serial bonds shall be issued to repre sent each assessment of Twenty-five (25) Dollars or more for the costs and expenses of said work or im provement. Said serial bonds shall extend over a period ending nine (9) years from and after the second day of January next succeeding the date of said bonds, and an even annual proportion of the principal sum thereof shall be payable by coupon on the second day of January every year after their date until all is paid and the interest shall be pay able semi-annually by coupon on the second day of January and July re spectively, of each year, at the rate of six (6) per cent per annum on all sums unpaid until the whole of said principal sum and interest are paid. Section 5. The serial bonds herein mentioned shall be issued in ac cordance with the provisions of an act of the Legislature of the State of Arizona, known and designated as the "Improvement Act of 1912," ap proved May 17, 1912, and all the proceedings in the aforementioned improvements shall also be taken un der said "Improvement Act of 1912," and subsequent amendments. Section 6. The City Clerk shall certify to the passage of this Reso lution of Intention, and shall cause the same to be published ten (10) times in the Arizona Republican, a daily newspaper published and circu lated in the City of Phoenix and hereby designated for that purpose. Section 7. The Superintendent of Streets of the City of Phoenix shall post notice of said proposed improve ment as required by law, and in said notices shall refer to this Resolution ol Intention. Reference is hereby made to the Bitulithic Mixtures License Agree ment of Warren Brothers Company of Boston, Mass., dated June 24, 1914, on file in the office of the City Clerk of the City of Phoenix. I hereby certify that the above and foregoing Resolution No. 38 was duly passed by the Commission of the City of Phoenix at a meeting held August 4th, 1914, and that a quorum was present thereat. ORDINANCE NO. 20 AN ORDINANCE ADOPTING PLAN'S FOR THE IMPROVEMENT OK MADISON STREET FROM THE WEST LI X E OF THIRD STREET TO THE EAST IJNE OF THIRD AVENUE, IN THE ORIGINAL TOWNSITE OF PHOENIX. RE IT ORDAINED BY THE COM MISSION riF THE CITY OF PHOE NIX AS FOLLOWS: Section 1. That the plans pre pared hy the City Engineer, for tho proposed improvement on Madison Street, are hereby adopted as the of ficial plans for said work. The evades shall be at elevations Known on the plans. The width and location of the roadways shall be as shown on these plans. Section 2. A duplicate copy of these plans shall be filed with the City Clerk, and kept on file, in his office. Section 3. This ordinance shall take effect and be in force from and after its passace and publication as by law required. Section 4. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are here hy repealed. PASSED by the COMMISSION of the City of Thoenix this 4th day of August 1914.
