The indictment of Senator Mitch ell wax in connection with land frauds perpetrated in the State of Oregon on December 7, 1 904. S. A. I). Puter and a number of other de fendants were convicted of conspira cy to defraud the government out of certain lands in the state of Oregon, and these defendants thereupon made confessions implicating certain men in high offices. Puter, in his confes sion, alleged that be had paid Sena tor Mitchell $2000 for securing Mit chell's influence in 7ushing . through certain fraudulent things in the land office. Upon hearing this charge Senator Mitchell left Washington and reach ed Portland on December 24, 1904. for the purpose of testifying before the prand jury. One of the strongest points in the government's case against Senator Mitchell was the testimony of Judge Tanner to the effect that when Mitchell came to Oregon on Decem ber, 1904, to appear before the gvand jury, he and Tanner had entered into an arrangement to prepare a new firm contract, under the terms of which Judge Tanner should be per mitted to hold for his own use, .'ill moneys received by the f i."m for ser -kcs rendered in any of the depart ments at Washington. The same grand jury found a second indictment against him on January 31, 1305, in connec tion with the additional alleged con spiracy of fraudulently securing government lands. The indictment on which the senator was convicted was found on February 1. It charged in seven different counts an unlawful agreement on the part of detectives in the service of the gov ernni"nt this transaction was run cown and Judge Tanner was con fronted with such proof of the fab rication of the contract as induced him to turn state's evidence. TRIAL OF SENATOR MITCHELL The trial of a United States sena' tor well within the memory of most leaders is that of Senator John H Mitchell, of Oregon, who was con victed on July 30, 1905, in the cir cuit court of his state of a violation of the law of the revised statutes to the effect that: "Xo senator, after his election, and during his continuance in office. spiracy to create a new forest re serve in the Blue mountains in eas- i tern Oregon, with a view to the profit 'for private individuals who were interested in utilizing lands al ready taken up. The indictment found on February 1 is the one which came on' first to be f.'ied and was the one which at tracted the largest share of attention. It was followed on February S by the indictment of Senator Mitchell's law partner, A. II. Turner, for the crime of perjury. The trial was held before Judge De Haven. His demur rer was based principally on the con tention that the indictment did" not charge him with knowledge of the receipt of any of the moneys which Kribs had paid and . also on the ground that it did not state that Senator Mitchell was a United States senator at the time named. The testimony for the government attempted to show that the moneys paid by Kribs were paid in the form of checks drawn in favor of the firm her S.
