AN ORDINANCE EMPOWERING THE CITY MANAGER TO PUR CHASE FROM THE UNITED STATES RECLAMATION SER VICE, IRRIGATION WATER FOR LOT OWNERS IN WEST CAPI TOL ADDITION. UNDER CER TAIN CONDITIONS. BE IT RESOLVED BY THE COM MISSION OF THE CITY OF PHOENIX. AS FOLLOWS: Section 1. The City Manager is hereby authorized, empowered, an! directed, to purchase in the name of th-? City of Phoenix, irrigation water from the United States reclamation service, for delivery to and use unci) lots in West Capitol Additi n, as :;!ia!l or may be required or need ed by said lot owners, whenever 'the said lot owners shall so request. and shall pay into the City Treasury of the City of Phoenix therefor, the 1 1 ice end cost of such water so re- f;ned or desired to be used by them respectively, until and up to the be ginning of the then next irrigation season. Section 2. Section 3. The City shall not charge or retain any amount or amounts of money to or from the lot owners or occupants in West Capitol Addition respectively, for the services and use of irrigation there on and therefor, other than the amount or amounts charged to and paid by the City to the United States Reclamation Service therefor; and the City of Phoenix shall not make or incur any expense or expenditures for the keeping up, maintenance and operation of headgates or laterals in West Capitol Addition, or for the distribution and partition of water to and among the various lot owners therein, other than such expense and expenditures as is otherwise herein provided; provided that if the lot owners anil occupants under a par ticular lateral or -laterals shall fail, neglect or refuse to keep and main tain the said lateral or laterals clean and in a good state of condition and repair, and free and clear of all weeds, grasses, debris and trash, then the City Manager shall forthwith re quest the proper officials of the United States Reclamation Service to cease and refrain from the service and delivery of any further irriga tion water through the head -gate and lateral, until further notice from the City Manager, which said notice shall not be given until after the said lot owners and occupants shall put the said ditch and lateral in good condi tion and repair and to the satisfac tion of the City Manager. Section 4. No persor. or persons shall obstruct, hinder or impede, or interfere with the flow of water in and through any headgate or lateral in West Capitol Addition, except only officers of the United States Recla mation Service thereunto authorized, and the person or persons occupying, using, or cultivating lots lying under and irrigable from a particular la teral or laterals therein, and who has or have paid into the City treas ury the sum or sums of money so estimated as sufficient for the amount or amounts of water required for said lot or lots, during said ir rigation season, and any person ot Ull 1 ili II. Section fi. Whereas, by the terms of the Ordinance annexing West .Capitol Addition to the City of Phoe jnix. it is provided that the persons owning, using and occupying lots in j West Capitol Addition, reserve and j retain the right to purchase, irriga tion water for the irrigation of their i said lots, direct from the United States Reclamation Service, and free from the interference or control of the City of Phoenix, and AVhereas, under recent ruling of the Secretary of the Interior, owners of lots, pieces and parcels of land, lying and embraced within the boundaries of an incorporated city, are no long er permitted to deal directly with the United States Government in the purchase of water and water service for said lots, pieces and parcels of land, and Whereas, on various of the lots in West Capitol Addition there are val uable trees, shubbery, foliage, pow ers, and verdure, all of which re quires immediate irrigation and ser vice of water to prevent serious loss thereto, and the provisions of this or dinance are necessary for the imme diate preservation of the peace, health and safty of tire City. An emergency is hereby declared to exist, and this Ordinance shall be in full force and effect from and after its passage by the commission, and approval by the mayor, and shall be published as required by the City Charter. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF PHOENIX, as follows: Sec. 1. The office of Deputy City Clerk is hereby created. Sec. 2. The Deputy City Clerk shall be appointed by the Commission, and shall hold his office until removed by a vote of three fifths (3-5) of the Com mission, subject to the control and su pervision of the City Clerk. He shall have and exercise all the powers, and may jerform and discharge all the du tieu which now are or hereafter may be conferred or imposed upon the City Clerk by any law of the state of Arizo na, by the City charter of the City of Phoenix, or by any ordinance or, reso lution of the City: and in addition t the aforesaid rowers and duties, the Deputy City Clerk shall have and ex ercise and perform such other and fur ther powers and duties as the Com mission may prescribe from time to time, by ordinance or resolution. Sec. 3. Before entering upon the performance of the duties of his office, the Deputy City Plerk shall make and file hi"? official bond, conditioned as required by law. in the sum of Five Thousand Dollars ($5000.00). Sec. 4. The Deputy City Clerk shall receive such compensation as may be by resolution fixed by the City Com mission, payable in equal semi-monthly installments, which said compensation shall be in full satisfaction of and for any and all duties and services pertain ing or to pertain to his said office, as well as of and for all duties and serv ices which are or may be required of him by and under lawful authority. Sec. 5. WHEREAS, the present City Clerk, is ill and there being no official who may lawfully perform the duties of the office of City Clerk, an urgent ne cessity exists for the immediate crea tion of the office of Deputy City Clerk, for the proper carrying on of the busi ness and conduct of the affairs of the City, and WHEREAS, the provisions of this ordinance are necessary for the imme diate preservation of the peace, health 'r..l safety of the City, an emergency is hereby declared to exist, and this ordinance shall be in full force and ef fect from and after its passage by the Commission, ami approval by the Mayor PASSED by the Commission of the City of Phoenix, this 24th day of May. Council Meets With Obstacles in Ad justing Assessment Roll Sprink ling Contract Awarded Sttif:iotorilv adiustinsr the areas to be assessed for the construction of the new sewer system., is proving quite a task for Tempe's aldermen. Tempe was so laid out in its early days, that in some corners of the town, especially in east Tempe, where the property bord ers along a curve of the railroad, figur ing out the area of certain plots of ground is no easy job. The council met Monday evf ning to hear any complaints against the area estimates, and some lew changes will likely be made before the assessment roll is completed. In a few sections of the town, property lines" are just a little in doubt, and in those instances there is some difference in opinion as to the true size of the area to be assessed. Eventually the council adjourned to await the pres ence of the engineer who will be called up to take an accurate survey of the boundary lines and compile from those the square foot area. Another meeting of the aldermen will be held on the third of next month, when it is thought that the sewer assessment roll will be 4- ? Adv. tf THE BEST BEEF An eypn half dozen cars of the best beef cattle to be found hereabouts were shipped last evening under special con signment to the Pacific Coast Peef and Provision company of Los Angeles. It was a mixed shipment chosen here and there at the will of the purchasers. The Wirkelman train brought in two car Ijad from Florence and a third from Mesa. In Tempe a fourth car was ad ded and on its departure from the val ley the shipment was increased two more oftrs by additions from the com pany's ranch at Hansen Junction. Oc cupants Uninjured ' What is considered a miraculous I escape from serious injury was that tf Saturday afternoon when the car being driven by Donald McQueen and with Mrs. McQueen and Mr. and Mrs. L. At a rather narrow place on the road a new F.uick " was met ascending the hill. Apparently the driver of the car was confused and the McQueen car was crowded to the inside of the roadway. The Mc Queen car ran into the hillside and turned on its side throwing the oc cur ants to the ground. Mr. McQueen qi.ickly regained his feet and held the weight of the car on his should er preventing it from turning over j until the occupants were able to get out of the way. The car was some what damaged and it was necessary to telephone the local Ford garage to riirni.sh supplies before the return trip could be made. Snider, president of the Miami Oil and Development Com pany was in own yesterday in the interest of his concern. The company holdings are located in the famous Tonto Basin. He says his company will control about six thousand acres of land. The holdings of his company are located two or three miles from what i3 known as the Fleming well which has been mentioned many times in the press of this country.
