Legal Advertising RESOLUTION NO. 362 A resolution of the c ommission 0! the City of Phoenix declaring it3 intention to improve certain portions of Roose velt Street, in the City of I'hoenix, and determining that bonds shall be issued to represent the costs and expenses 1 hereof, and declaring the work or im provement to be of more than local or ordinary public benefit, and that the 1 -outs' ot said work or Improvement shall l.e assessed upon a certain. trict and providing that the proposed work or improvement shall be per formed under Title VII, Chapter XIII. Revised statutes of Arizona 1913 Civil Code, and amendments thereto. BE IT RESOLVED BY THE COM MISSION OF THE CITY OF PHOENIX: .SECTION 1. That the public inlet est and conven ience require, and that it is the inten 1 ion of the Commission of the City of Phoenix, to order the following work to be performed, to-wit: 1. That the roadway of Roosevelt Street between the east line of Central Avenue and the west line of Seventn Street, including, the intersection of all streets aJid alleys, (except that portion of Koo.evelt Street now occupied by the tracks of the Phoenix Street Rail way Company and two (2) feet on the outside of each rail) be graded and paved with bitulithic paving with bi tuminous concrete base as per Speci fication No. 26A. 2. That all private drives on both sides 01" Roosevelt Street between Cen tral Avenue and Seventh Street be graded and paved to a depth of five (5) inches with cement concrete as per Specification No. 30A. 3 That combined cement concrete curb and gutter be constructed on both edges of the roadway of Roosevelt Street from the east line or Central Avenue to the west line of Seventh street ( except at the intersection of all private drives and excepting also at the intersection of First Street, Sec ond Street, Third Street, Fourth Street, Fifth Street and Sixth Street as shown on the plana. That combined cement concrete curb and gutter be constructed on both edges of the roadway of Second Street on the north side of Roosevelt Street on the north edge ot the roadway of Uooseveit Street on both sides of Sec ond Stre t; on both edges of the road way of Third Street on the north side of Roosevelt Street: on the north edge of the roadway of Roosevelt Street on both sides of Third Street, on both edges ct the roadway of Fourth Street on the south side of Roosevelt Stret: iid on the south edge of Roosevelt S.roct on both sides of Fourth Street. as shown on the plans. 4. lhat cement concrete curb be constructed on both edges of the road way of First Street; Second Street; Third Street; Fifth Street and Sixth Stieet on the south side of Roosevelt Street; and on the south edge of the roadway of Roosevelt Street on both sides of First Street; Second Street; Third Street; Fifth Street and Sixth Street and on both edges of the road way on Fifth Street on the north side of Roosevelt Street and on the north edge of the roadway of Roosevelt Street on both sides of Fifth Street, as shown on- tbo plans. 5. That cement concrete gutter be constructed across the roadway of First f-treet on the north side of Roosevelt Street; on both edges of the roadway of First Street on the north side of Roosevelt Street, and across all alleys and private drives as shown on the plans. 6. That one (1) storm water man hole be constructed at each of the fol lowing locations on Roosevelt Street, near the east line of Central Avenue; net r the east line of Second Street, near the center line of Fourth Street: near the east line of Fifth Street as shown on the plans. 7. That feven (7) sutler inlets constructed at the fallowing locati-ms. Central Avenue and Roosevelt Street two (2); Second Street and Roosevelt Street one (1); Fourth Street and Roosevelt Street, three (3); Fifth Street and Roosevelt Street one (1); as shown on the plans. 8. That corrugated iron pipe fifteen (15) Irenes in diameter be laid across the roadway of First; Second; Third: brd Fifth Streets on both sides of Roosevelt Street, and across the road way of Fourth Street and Sixth Street on the south side of Roosevelt Street fnd across the intersection of all al leys, ns shown on the plans. 9. That cement concrete standpipes be constructed at the following loca tions, Fifth Street, one (1); alley be tween Second and Third Street on south side of Roosevelt Street, one (1), as shown on the plans. 10 That cement concrete pipe of the size to fit the aforementioned cor rugated Iron pipe be laid from the stand pipes and corrugated Iron pipe to a point six (6) feet back 01 property lines and from gutter inlets to storm water manholes, as shown on the plans. 11. That sheet metal gates be placed in the standpipes to control the flow of water; as shown on the plans. 1'. That street signs be placed at the following intersections of Roose velt Stieet First Street, eight (8); Second Street, eight (8): Third Street, six (6); Fourth Street, two (2): Fifth Street, eight (8); Sixth Street, four (4): as shown on the plans.. 13. That monument covers fur nished by the City, be placed at the following locations on Roosevelt Street, First Street, two I); Second Street, two (2); Third Street, two (2); Fourth Street, one (1); Fifth Street, two (2); Sixth Street, one (1); as shown on the plans. 14. That the roadway of Interest ing streets be graded from the afore mentioned pavement, not to exceed ten (10) per cent until it meets the original surface. All of the above -work or improve ment to be done in accordance with that certain set of plans approved and adopted by the Commission of the City of Phoenix on the 21st day of Miy, 1919, and on file in the office or the City Engineer in Book Five of Street improvement Plans, on Pages 75 to 82 inclusive, and in further ac cordance with the following specifi cations: Standard Specifications of the City of Phoenix, Numbers 19, 21, 22, 24, 26A, 2S and 30A. All of which above specifications are on Hlo in the office of the City Clerk of the City of Phoenix. Said plans and spt cifications arc hereby referred I to for a more particular description of said work and made a part hereof. Reference is hereby made to the bitulithic license agreement of Warren Brothers Company of Boston Mass., dated April 2nd, 1918, and on file in the office of the City Clerk of the. City of Phoenix. SECTION 2. That the said contemplated work or improvement in the opinion of the Commission, is of more than local or ordinary public benefit, and that the said Commission hereby makes the costs and expenses of said work or im provement chargeable upon a district, and hereby declares that the district in said City of Phoenix, benefited by the said work or improvement, and to be assessed to pay the costs and ex penses thereof, is described as fol lows : South half of Blocks one and two, Evergreen Place. South half of Block 3, Central Addi tion. Soulh half of Blocks 3 and 4, East Evergreen. North half of Blocks 7, 8, 21, 22 . 36 and 49. Churchill. Reference is hereby made to Book One of Assessment District Diagrams Pages 20 to 22, on file in the office or the City Engineer of the City of Phoe nix, for a more complete and detailed description of said district. SECTION 3. The said Commission finds that pub lic convenience requires that serial bonds shall be issued to represent the costs end expenses of such work or improvement, and said Commission de termines that serial bonds shall be issued to represent each assessment of Twenty -five ($25.00) Dollars or more for the costs and expenses of said work or improvement. Said serial bonds shall extend over a period ending nine (9) years from and after the second day or January next succeeding the data of said bonds and an even annual proportion of the principal sum there of shell be, payable by coupon on the second day of January every year after their date until all is paid, and the In terest shall be payable semi-annually by ooupon on the second day of Janu ary and July respectively of each year, at the rate of six (6) per cent per an num, on all sums unpaid, until the whole of said principal sum and In terest are paid. SECTION 4. That these improvements shall be made, and all proceedings therein shall lie taken; that the Superinten dent ot Streets shall post notices thereof; that the City Clerk shall cer tify to the passage of this Resolution of Intention and shall cause the same to be published in the Arizona Repub lican, a daily newspaper published and circulated in the City of Phoenix and hereby designated for that purpose, that the City Engineer shall prepare duplicate diagrams of the district hereinabove described in Section 2, of this Resolution ot Intention, to be as sessed to pay the costs and expenses thereof, under and in accordance with the provisions of Title VII, Chapter XIII, Revised Statutes of Arizona 1913 Civd Code, and subsequent acts amendatory thereto.
