The bill of revivor and supplement sets forth that the defendant Jonas Richardson has deceased since the filing of the original bill, and that Charles IN. Alexander in copartnership with James Martin. The bill slates tiiat Mr. Alex ander died intestate as respects Ins real estate, with out ever having married—that Mrs. F. M. Caldwell was his sister, who is dead, leaving the following children and heirs: Archibald II. ('aidwell, Elizabeth Caldwell, Richard Caldwell, Julius Caldwell, and Frances CaldAell, all of whom are under the age of twenty-one years, residing in the State of North Ca rolina, of whom David F. Caldwell is the father, who also resides in North Carolina. Erwin, admY., Anne Hitchcock, Caroline Hitchcock, Henry Hitchcock, Andrew Hithcock and Ethan A. Hitchcock, defendants. THE bill in this case is filed to foreclose a mort gage executed by Henry Hitchcock to the complainant for square no. 18 of the Fnvre tract .of land, situated in the city of Mobile. And now the complainant comes by his solicitor and applies for an order of publication, and it appear ing to the, satisfaction of the Register from an affidavit on file, that the defts Anne Hilcheock, Caroline, Henry, Andrew and Ethan A. Hitchcock arc non-re sidents of the stale of Alabama, that Anne Hitchcock resides at or near Lexington in the state of Kentucky, and that the others of tile said!iion-resident defts, ore all infants and reside with their mother the said Anne. The said non-resident defts are ordered to appear on or before the first day *f the next term of the court of chancery for the first district, of the southern chan cery division of the state of Alabama at Mobile to be held on the second Muiidoy of May next, and answer or demur to the lull of complaint.
