Robinson of certain real estate in the city of Mobile, situated in State sc., between Water and Commerce sis. The bill farther sets forth that tin; said deed of mortgage was subject to certain conditions by the performance of which the Maid mort gage would he defeated, that those conditions have not been performed, and lh.it the mortgage and notes have been assigned and transferred to the complain ant.
