Kitchen was indebted to Edwin and Francis Robinson iu the sum of ty‘1926 65-100, and that to secure the puyinent of that sum, said Kitchen executed his certain indenture of mort gage to said E. & F. Robinson of certain real estate hi the city of Mobile, situated in State st., between Water and Commerce sts. The bill farther sets forth that the said deed of mortgage was subject te certain conditions by the performance of which the said mort gage would be defeated, that those conditions linve not Im pn jrerformed, ami that the mortgage and notes have been assigned anil transferred to the complain ant. The bill furth- r alleges that the other defendants above named have or pretend to have some title to the mortgaged premises, nnd prays that the mortgaged property may be sold and the equities of all ths de fendants be foreclosed. And now the complainant comes by its solicitor, and upplics for an order of publication, and it appear ing to the Register, from ail affidavit oil file, that the the defendants Henry P. Norris, Henry Parrish aud Daniel Parrish, are residents of the City and State of New York, and that the defendant Leltoy M. Wi ley is a resident of Charleston in the State of South Carolina, they are ordered to appear at (he next term of the court of chancery for the first district of tin southern chancery division of the State ofAluhnma, at Mobile, to be held on the second Monday of May next, and answer or demur to the said complainants bill of complaint.
