Gentlemen In a pamphlet recently circulated by your committee, giving your reasons for protesting against the appointment of Hon. John R. Mc Fie as judge, appears, under the head ing of the "Sargent Case"' the follow ing: The third provision on page 3"4 of the laws of 1909, affords the relief needed by Sargent, and was sneaked into the appropriation bill and over looked by the governor in the great rush during the closing hours of the i session of the legislature." The charge , that the item referred to having been sneaked into the appropriation bill and overlooked by the governor, is abso lutely false. Any one, who followed the course of the appropriation bill in the council, must know, that this item was openly and fully discussed by Mr. Catron and Mr. Upton or Judge Hewitt. I will also state and if necessary make affidavit, that Governor Curry, was fully aware that this item was to go into the appropriation bill, as I, in person, submitted to ihim a draft of this item, before the same was passed by the legislature, and that, it met with his approval. As I cannot understand what bear ing this charge has, on Judge McFie's case, I take it for granted, that, the charge is intended to reflect on me (rectly, and take this opportunity of publicly denouncing it, as absolutely false. One of the most interesting reports of the meeting will be that of the executive secretary, Dr. Livingston Farrand, showing the growth of the anti-tuberculosis movement since May I, 1909. The number of associations for the prevention of consumption has increased from 290 to over 425; the number of sanatoria and hospitals for the treatment of tuberculosis from 29S to 400; and the special tuberculos is dispensaries from 222 to 265. Dur ing the year 1909, thirty-six out of forty-three legislatures in session con sidered the subject of tuberculosis, and in twenty-eight, bills were passed for the prevention or treatment of this disease. Since the opening of the legislative season of 1910, out of ten legislatures in session up to May 1, all have considered the subject of tuberculosis and every one of them has enacted some law that bears on this subject.
