A threat of impeachment proceeding against Smith McPherson, of Red Oak, Iowa, United States District Judge, was made public today by the Judge through Federal Commissioner Mc Arthur. The threat came from Hugh J. O'Brien, of Rochester, N. Y., an attor ney, who demanded the reoptning of tne bankrucptcy case of the Sidney Company, of Ottumwa, Iowa. In his reply to the New York at torney Judge McPherson said: "I note the recital in your letter that i! I fail or refuse to make and endorse an order on Mr. Loomis, once the re ceiver of my court, to pay the New lork state receiver $572.58 that you will present the matter to the Judi ciary Committee of the House of Re presentatives, asking for my impeach ment and removal. Such service is vol untary, not compulsory, and no fair argument can be advanced against im posing conditions reasonably needed for the protection of the public wel fare on Individuals who voluntarily seek to engage in such service. "A strike by enliBted men would be mutiny, the punishment for which, of course, should be fixed by law. Coincl- dentally with legislation of this kind I would hope to see legislation provid ing ample safeguards for the protec tion of all just rights of the enlisted men, including the right of petition for the redress of grievances, with adequate provision for the obtaining ot redress wherever justified." Congressman Tavenner, who first dug up and gave some publicity to the Towne letter, commented on the mat ter today as follows: "Governor Foss' proposition follows closely the plan for subjugating labor that Towne. has in mind. In answer ing questioins put by Senator Reed on : the witness stand, Mr. Towne declared j that he expects to live to see his prop I osition enacted into law. Governor Foss proposes to put It into law. Mr. Towne estimated that 5,000,000 wage workers would be included In his scheme of enlistment subject to pun ishment as mutiny In case of strikes. The argument advanced by Mr. Towne that 'service is voluntary, not com pulsory' is fictitious. No labor is vol untary; all labor is compulsory, since self-respecting men must labor to I live and must accept the jobs which : are offered. I Atoona, Pa., Oct. 9. With hiB skull fractured by some object knocked from a passing freight train, John Siloan, engineer of Metropolitan ex press, one of the fast Pennsylvania Railroad trains, lay in the gangway of the locomotive while his train thundered over the switches in the Connemaugh yards. When the train continued wildly on its way the fireman, McKee Ullery, in vestigated and found the engineer's body. He stopped the train. The engineer's forehead was deeply cut, exposing the skull, and he was bleeding from the nose and mouth. The train was run on to the Conne maugh station, where the engineer was turned over to physicians, and an other engineer brought the train into Altoona, Sloan's condition is critical.
